| AN ACT |
| |
1 | Amending Title 23 (Domestic Relations) of the Pennsylvania |
2 | Consolidated Statutes, providing for disposition of agency |
3 | records upon closure. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Title 23 of the Pennsylvania Consolidated |
7 | Statutes is amended by adding a section to read: |
8 | § 2911. Disposition of agency records upon closure. |
9 | As soon as practicable, but no less than 30 days prior to the |
10 | date on which an agency will cease to operate as a legal entity |
11 | in this Commonwealth, the agency shall, unless it has applied to |
12 | operate as a new legal entity, notify the Department of Public |
13 | Welfare of its intention to cease operating. Within this time |
14 | period, the agency shall submit a plan to the department |
15 | relating to the closure and transfer of case records to another |
16 | agency. The plan shall be subject to approval by the department. |

1 | In preparation for closure and transfer of case records, the |
2 | agency shall label its case records to identify the court that |
3 | finalized an adoption or the court where a petition to terminate |
4 | parental rights or to adopt has been filed. The Within 30 days | <-- |
5 | following approval of a plan, the department shall notify each |
6 | court identified by the agency of the name, address and |
7 | telephone number of the agency that has ceased to operate and | <-- |
8 | the agency to which case records have been transferred. |
9 | Section 2. This act shall take effect in 180 days. |
