AN ACT

Amending the act of October 6, 1998 (P.L.705, No.92), entitled,

2

as amended, "An act providing for the creation of keystone

3

opportunity zones and keystone opportunity expansion zones to

4

foster economic opportunities in this Commonwealth, to

5

facilitate economic development, stimulate industrial,

6

commercial and residential improvements and prevent physical

7

and infrastructure deterioration of geographic areas within

8

this Commonwealth; authorizing expenditures; providing tax

9

exemptions, tax deductions, tax abatements and tax credits;

10

creating additional obligations of the Commonwealth and local

11

governmental units; and prescribing powers and duties of

12

certain State and local departments, agencies and officials,"

13

providing for work performed.

The General Assembly of the Commonwealth of Pennsylvania

15

hereby enacts as follows:

Section 1.  The act of October 6, 1998 (P.L.705, No.92),

17

known as the Keystone Opportunity Zone, Keystone Opportunity

18

Expansion Zone and Keystone Opportunity Improvement Zone Act, is

19

amended by adding a section to read:

Section 1301.1.  Work performed.

(a)  General rule.--When a political subdivision has

2

provided, approved or authorized a tax abatement or tax

3

exemption for a property or project under this act, all

4

construction, reconstruction, demolition, alteration and repair

5

work other than maintenance work performed on a property shall

6

be done in accordance with the act of August 15, 1961 (P.L.987,

7

No.442), known as the Pennsylvania Prevailing Wage Act.

8

(b)  Applicability.--This section does not apply to

9

residential buildings.

(c)  Definitions.--The following words and phrases when used

11

in this section shall have the meanings given to them in this

12

subsection unless the context clearly indicates otherwise:

13

"Maintenance work."  Repair of existing facilities when the

14

size, type or extent of the facilities is not thereby changed or

15

increased.

16

"Residential building."  A building used as a residence that

17

is not more than three stories in height, not including any

18

basement level, regardless of whether any portion of that

19

basement is at grade level.

20

Section 2.  The addition of section 1301.1 of the act shall

21

apply to all contracts entered into on or after the effective

22

date of this act.

Section 3.  This act shall take effect immediately.
