                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, defining, in theft and related
     3     offenses, "firearm"; and further providing for grading of
     4     theft offenses.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 3901 of Title 18 of the Pennsylvania
     8  Consolidated Statutes is amended by adding a definition to read:
     9  § 3901.  Definitions.
    10     Subject to additional definitions contained in subsequent
    11  provisions of this chapter which are applicable to specific
    12  provisions of this chapter, the following words and phrases when
    13  used in this chapter shall have, unless the context clearly
    14  indicates otherwise, the meanings given to them in this section:
    15     * * *
    16     "Firearm."  A weapon that is designed to or may readily be
    17  converted to expel a projectile by the action of an explosive or
    18  the frame or receiver of any such weapon.

     2     Section 2.  Section 3903(a)(3) of Title 18 is amended to
     3  read:
     4  § 3903.  Grading of theft offenses.
     5     (a)  Felony of the second degree.--Theft constitutes a felony
     6  of the second degree if:
     7         * * *
     8         [(3)  In the case of theft by receiving stolen property,
     9     the property received, retained or disposed of is a firearm
    10     and the receiver is in the business of buying or selling
    11     stolen property.]

    13     Section 3.  This act shall take effect in 60 days.
