                                     AN ACT

     1  Amending the act of July 3, 1985 (P.L.164, No.45), entitled "An
     2     act relating to the prevention and reduction of premature
     3     death and disability in this Commonwealth; providing for
     4     assistance, coordination and support of the development and
     5     maintenance of a comprehensive emergency medical services
     6     system and for qualifications, eligibility and certification
     7     of emergency medical services personnel and licensing
     8     ambulance services; imposing powers and duties on the
     9     Department of Health; and making repeals," further providing
    10     for the Emergency Medical Services Operating Fund; and making
    11     an appropriation.

    12     The General Assembly of the Commonwealth of Pennsylvania
    13  hereby enacts as follows:
    14     Section 1.  Section 14 of the act of July 3, 1985 (P.L.164,
    15  No.45), known as the Emergency Medical Services Act, is amended
    16  to read:
    17  Section 14.  [Support of emergency medical services] Emergency
    18                 Medical Services Operating Fund.
    19     [(a)  Fine.--A $10 fine shall be levied on all moving traffic
    20  violations. These fines shall be in addition to other fines
    21  imposed at the discretion of the court.
    22     (b)  Emergency Medical Services Operating Fund.--Money


     1  collected shall be paid to the court imposing the fine which
     2  shall forward it to the State Treasurer for deposit into a
     3  special revolving fund to be known as the Emergency Medical
     4  Services Operating Fund.
     5     (c)  Purpose of fund.--All money from the Emergency Medical
     6  Services Operating Fund] (a)  Establishment and purpose.--There
     7  is hereby established a separate account in the State Treasury
     8  to be known as the Emergency Medical Services Operating Fund.
     9  This fund shall be administered by the department. All moneys in
    10  the fund shall be disbursed by the department for the
    11  initiation, expansion, maintenance and improvement of emergency
    12  medical services, and emergency medical services training of
    13  emergency service personnel.
    14     [(d)] (b)  Allocation to Catastrophic Medical and
    15  Rehabilitation Fund.--Twenty-five percent of the fund shall be
    16  allocated to a Catastrophic Medical and Rehabilitation Fund for
    17  victims of trauma. The catastrophic fund shall be available to
    18  trauma victims to purchase medical, rehabilitation and attendant
    19  care services when all alternative financial resources have been
    20  exhausted.
    21     Section 2.  The sum of $6,000,000, or as much thereof as may
    22  be necessary, is hereby appropriated from the General Fund to
    23  the Emergency Medical Services Operating Fund for the fiscal
    24  year July 1, 1986, to June 30, 1987.
    25     Section 3.  (a)  Section 2 of this act shall take effect July
    26  1, 1986.
    27     (b)  The remainder of this act shall take effect in 60 days.
