                                     AN ACT

     1  Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
     2     act to consolidate, editorially revise, and codify the public
     3     welfare laws of the Commonwealth," further providing for
     4     other medical assistance payments.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 443.3, act of June 13, 1967 (P.L.31,
     8  No.21), known as the "Public Welfare Code," added July 31, 1968
     9  (P.L.904, No.273), and amended November 28, 1973 (P.L.364,
    10  No.128), is amended to read:
    11     Section 443.3.  (a)  Other Medical Assistance Payments.--
    12  Payments on behalf of eligible persons shall be made for other
    13  services, as follows:
    14     (1)  Rates established by the department for outpatient
    15  services as specified by regulations of the department adopted
    16  under Title XIX of the Federal Social Security Act consisting of
    17  preventive, diagnostic, therapeutic, rehabilitative or
    18  palliative services; furnished by or under the direction of a
    19  physician, chiropractor, or podiatrist, by a hospital or


     1  outpatient clinic which qualifies to participate under Title XIX
     2  of the Federal Social Security Act, to a patient to whom such
     3  hospital or outpatient clinic does not furnish room, board and
     4  professional services on a continuous, twenty-four hour a day
     5  basis.
     6     (2)  Rates established by the department for (i) other
     7  laboratory and X-ray services prescribed by a physician,
     8  chiropractor or podiatrist and furnished by a facility other
     9  than a hospital which is qualified to participate under Title
    10  XIX of the Federal Social Security Act, (ii) physician's
    11  services consisting of professional care by a physician,
    12  chiropractor or podiatrist, in his office, the patient's home a
    13  hospital, a nursing home or elsewhere, (iii) the first three
    14  pints of whole blood, (iv) remedial eye care, as provided in
    15  Article VIII consisting of medical or surgical care and aids and
    16  services and other vision care provided by a physician skilled
    17  in diseases of the eye or by an optometrist which are not
    18  otherwise available under this Article, (v) special medical
    19  services for school children, as provided in the Public School
    20  Code of 1949, consisting of medical, dental, vision care
    21  provided by a physician skilled in diseases of the eye or by an
    22  optometrist or surgical care and aids and services which are not
    23  otherwise available under this article.
    24     (b)  In addition to those payments provided for in subsection
    25  (a), payments shall also be made on behalf of eligible persons
    26  for preventive, diagnostic, therapeutic, rehabilitative,
    27  palliative or other laboratory or x-ray services at rates to be
    28  established by the department when prescribed by a physician,
    29  chiropractor or podiatrist and performed at a primary health
    30  care facility other than a hospital, outpatient clinic or other

     1  facility qualified to participate under Title XIX of the Federal
     2  Social Security Act. Such primary health care facilities shall
     3  be deemed qualified to participate under the provisions of this
     4  subsection if they meet minimal standards to be set and
     5  administered by the Department of Health as to competency of
     6  staff and quality of health care facilities and equipment.
     7     Section 2.  This act shall take effect in 90 days.
