AN ACT
Amending Title 18 (Crimes and Offenses) of the Pennsylvania
Consolidated Statutes, in criminal history record
information, further providing for information in central
repository or automated systems.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 9106(c)(4) of Title 18 of the
Pennsylvania Consolidated Statutes is amended to read:
ยง 9106. Information in central repository or automated systems.

(c) Dissemination of protected information.--

(4) Investigative and treatment information shall not be
disseminated to any department, agency or individual unless
the department, agency or individual requesting the
information is a criminal justice agency which requests the
information in connection with its duties, and the request is
based upon a name, fingerprints, modus operandi, genetic
typing, voice print or other identifying characteristic. The

following shall apply:
(i) This paragraph shall not apply to information
pertaining to potential or prospective harm to public
health.
(ii) The Pennsylvania Office of Environmental
Justice shall evaluate investigative and treatment
information pertaining to potential or prospective risk
to public health. If the Office of Environmental Justice
determines that a potential or prospective public health
risk exists, the Office of Environmental Justice shall
publish a notice, including a summary of the public
health risk on its publicly accessible Internet website.
The Office of Environmental Justice may not publish the
notice of the public health risk if the notice would
compromise an investigation.

Section 2. This act shall take effect in 60 days.
