                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, further providing for
     3     blood tests in relation to paternity disputes.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 6136 of Title 42 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 6136.  Effect of test results.
     9     (a)  General rule.--Blood test results shall be considered
    10  prima facie evidence of paternity if the test results
    11  demonstrate more than 95% probability of excluding a man falsely
    12  accused of paternity. If the court finds that the conclusions of
    13  all the experts as disclosed by the evidence based upon the
    14  tests are that the alleged father is not the father of the
    15  child, the question of paternity, parentage or identity of a
    16  child shall be resolved accordingly. If the experts disagree in
    17  their findings or conclusions, the question shall be submitted
    18  upon all the evidence.

     1     (b)  Definition.--As used in this section, the term
     2  "excluding" means that it is genetically impossible for the
     3  alleged father to be the true biological father.
     4     Section 2.  This act shall take effect immediately.
