AN ACT

 

1Amending the act of June 2, 1937 (P.L.1198, No.308), entitled
2"An act relating to employes and organizations thereof;
3defining labor disputes; prescribing the procedure by which
4and the conditions under which injunctions may be granted in
5such disputes, and the scope thereof; declaring certain
6undertakings and promises between employers and employes
7contrary to public policy and void; prescribing the nature of
8proof necessary in actions arising out of labor disputes
9against persons or associations; prescribing the terms and
10conditions for bonds to be furnished prior to the issuance of
11injunctions; prescribing the procedure in case of appeal from
12granting injunctions; limiting the duration of temporary and
13permanent injunctions in case of labor disputes; and
14providing for the payment of costs; and repealing all acts or
15parts of acts inconsistent herewith," providing for award of
16reasonable costs, expenses and attorney fees in enforcement
17proceedings.

18The General Assembly of the Commonwealth of Pennsylvania
19hereby enacts as follows:

20Section 1. The act of June 2, 1937 (P.L.1198, No.308), known
21as the Labor Anti-Injunction Act, is amended by adding a section
22to read:

23Section 15.1. A party that fails to comply with a
24restraining order or temporary or permanent injunction granted
25in a case involving or growing out of a labor dispute shall be

1ordered, upon motion submitted by another party to the court for
2enforcement of the order or injunction and granting of the
3motion by the court, to pay all reasonable costs, expenses and
4attorney's fees incurred by the moving party on the motion.

5Section 2. This act shall take effect in 60 days.
