AN ACT
1 Amending the act of March 10, 1970 (P.L.168, No.66), entitled
2 "An act imposing a special tax upon realty of public
3 utilities; providing for distribution of moneys to local
4 taxing authorities in lieu of local real estate taxes;
5 conferring powers and imposing duties upon the Department of
6 Revenue, local assessing and other officials, and public
7 utilities; and providing penalties," changing the
8 distribution of the total realty tax equivalent.
9 The General Assembly of the Commonwealth of Pennsylvania
10 hereby enacts as follows:
11 Section 1. Section 7, act of March 10, 1970 (P.L.168,
12 No.66), known as the "Public Utility Realty Tax Act," is amended
13 to read:
14 Section 7. Distribution to Local Taxing Authorities.--(a)
15 From the reports received by it in each year pursuant to section
16 6, the department shall determine:
17 (1) The total tax receipts shown in all such reports.
18 (2) The total realty tax equivalent shown in all such
19 reports.
20 (b) On or before the first day of October of 1971 and of
21 each year thereafter, the department shall distribute to each
1 reporting local taxing authority [its share of] the total realty
2 tax equivalent determined pursuant to subsection (a)(2)[, which
3 share shall be the ratio which the total tax receipts reported
4 by that local taxing authority bear to the total tax receipts
5 determined pursuant to subsection (a)(1)].
6 (c) For the purpose of making such payment, the department
7 shall make requisition therefor in the manner prescribed by The
8 Fiscal Code.
9 Section 2. This act shall take effect immediately.
