AN ACT 1 Amending Title 71 (State Government) of the Pennsylvania 2 Consolidated Statutes, adding provisions to the State 3 Employee's Retirement Code relating to death benefits for 4 officers of the Pennsylvania State Police. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Sections 5704 and 5707 of Title 71, act of 8 November 25, 1970 (P.L.707, No.230), known as the Pennsylvania 9 Consolidated Statutes, added March 1, 1974 (No.31), are amended 10 by adding subsections to read: 11 § 5704. Disability annuities. 12 * * * 13 (g) If an officer of the Pennsylvania State Police has been 14 found to be eligible for a disability annuity and if the 15 disability is not service connected and if the disability has 16 been found to be total and permanent, to the extent that the 17 officer is unable to engage in any gainful occupation, such 18 officer shall receive a supplement equal to seventy per cent 19 (70%) of his final average salary less the sum of the annuity as
1 determined under subsection (a) of this section and any payments 2 paid or payable on account of such disability under the Federal 3 Social Security Act. Such supplement shall continue as long as 4 he is determined to be totally and permanently disabled on 5 account of his nonservice connected disability. 6 § 5707. Death benefit. 7 * * * 8 (f) In the event of the death of an active member who is an 9 officer of the Pennsylvania State Police, and if his death is or 10 is not service connected, there shall be payable; to his widow 11 so long as she remains his widow, and if and when such widow 12 dies or remarries, then to his children under eighteen years of 13 age, and if and when there are no children under eighteen years 14 of age, then to the parent or parents of the deceased officer of 15 the Pennsylvania State Police if they are dependent; an annuity 16 equal to fifty per cent (50%) of his final average salary. In 17 the event payment is made under this subsection, there shall be 18 no other death benefits payable from the fund to which such 19 deceased officer of the Pennsylvania State Police may have 20 otherwise been entitled.
