        REFERRED TO COMMITTEE ON HEALTH AND WELFARE, APRIL 18, 1989

                                     AN ACT

     1  Requiring persons with acquired immune deficiency syndrome
     2     (AIDS) to notify certain medical personnel; and providing a
     3     penalty.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6  Section 1.  Notice.
     7     Any person who has acquired immune deficiency syndrome (AIDS)
     8  or AIDS-related complex (ARC), or who has tested positive for
     9  Human Immunodeficiency Virus (HIV) and has been informed of that
    10  fact based upon medical testing, shall so inform medical
    11  emergency and law enforcement personnel prior to any medical
    12  treatment, the performance of any invasive procedure or coming
    13  into contact in any manner likely to result in exposure to
    14  bodily fluids. The term "medical and emergency personnel" means
    15  any person who may be exposed to any bodily fluids of the
    16  infected person and shall include, but not be limited to,
    17  physicians, dentists, nurses, laboratory technicians, medical

     1  technologists, emergency medical personnel and law enforcement
     2  officers.
     3  Section 2.  Penalty.
     4     A violation of this act constitutes a misdemeanor of the
     5  second degree.
     6  Section 3.  Effective date.
     7     This act shall take effect immediately.
