AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, further providing for suspension of registration 3 and operating privileges relating to failure to maintain 4 financial responsibility. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Section 1786(d) of Title 75 of the Pennsylvania 8 Consolidated Statutes is amended to read: 9 § 1786. Required financial responsibility. 10 * * * 11 (d) Suspension of registration and operating privilege.--The 12 Department of Transportation shall suspend the registration of a 13 vehicle for a period of three months if it determines the 14 required financial responsibility was not secured as required by 15 this chapter and shall suspend the operating privilege of the 16 owner or registrant for a period of three months if the 17 department determines that the owner or registrant has operated
1 or permitted the operation of the vehicle without the required 2 financial responsibility. The operating privilege shall not be 3 restored until the restoration fee for operating privilege 4 provided by section 1960 (relating to reinstatement of operating 5 privilege or vehicle registration) is paid. Whenever the 6 department revokes or suspends the registration of any vehicle 7 under this chapter, the department shall not restore the 8 registration until the vehicle owner furnishes proof of 9 financial responsibility in a manner determined by the 10 department and submits an application for registration to the 11 department, accompanied by the fee for restoration of 12 registration provided by section 1960. This subsection shall not 13 apply in the following circumstances: 14 (1) The owner or registrant proves to the satisfaction 15 of the department that the lapse in financial responsibility 16 coverage was for a period of less than [31] 45 days and that 17 the owner or registrant did not operate or permit the 18 operation of the vehicle during the period of lapse in 19 financial responsibility. 20 (2) The owner or registrant is a member of the armed 21 services of the United States, the owner or registrant has 22 previously had the financial responsibility required by this 23 chapter, financial responsibility had lapsed while the owner 24 or registrant was on temporary, emergency duty and the 25 vehicle was not operated during the period of lapse in 26 financial responsibility. The exemption granted by this 27 paragraph shall continue for [30] 45 days after the owner or 28 registrant returns from duty as long as the vehicle is not 29 operated until the required financial responsibility has been 30 established. 20010H1141B1322 - 2 -
1 (3) The insurance coverage has terminated or financial 2 responsibility has lapsed simultaneously with or subsequent 3 to expiration of a seasonal registration, as provided in 4 section 1307(a.1) (relating to period of registration). 5 * * * 6 Section 2.
