                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, providing for the offense of failure to drive a
     3     vehicle at a safe speed in an emergency response zone.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 75 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 3327.  Failure to drive vehicle at safe speed in emergency
     9             response zone.
    10     (a)  Offense defined.--Within 1,000 feet prior to and 1,000
    11  feet after an emergency response zone, no person shall drive a
    12  vehicle at a speed greater than:
    13         (1)  25 miles per hour in a zone which is designated 35
    14     to 45 miles per hour or greater; or
    15         (2)  45 miles per hour in a zone which is designated 55
    16     miles per hour or greater.
    17     (b)  Penalty.--Any person violating this section commits a


     1  summary offense and shall, upon conviction, be sentenced to pay
     2  a fine of:
     3         (1)  $42.50 when the violation occurs in a zone which is
     4     designated 55 miles per hour or greater; or
     5         (2)  $35 when the violation occurs in any other speed
     6     zone.
     7     (c)  Marking.--An emergency response zone shall be clearly
     8  marked with either road flares, caution signs or any other
     9  traffic-control device which law enforcement officials may have
    10  at their immediate disposal.
    11     (d)  Definition.--As used in this section, the term
    12  "emergency response zone" means the area in which police, fire,
    13  rescue and ambulance personnel render emergency assistance to
    14  individuals on or near a roadway.
    15     Section 2.  This act shall take effect in 60 days.
