                                     AN ACT

     1  Authorizing the Township of Sewickley, Westmoreland County, to
     2     convey a portion of Project 70 land located in the Village of
     3     Rillton for a private roadway.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  (a)  Pursuant to the requirements of section
     7  20(b), act of June 22, 1964 (Sp.Sess., P.L.131, No.8), known as
     8  the "Project 70 Land Acquisition and Borrowing Act," the General
     9  Assembly hereby authorizes the Township of Sewickley,
    10  Westmoreland County, (grantor) to convey the hereinafter
    11  described parcels of Project 70 land free of restrictions on use
    12  and alienation prescribed by section 20 of the "Project 70 Land
    13  Acquisition and Borrowing Act," to Dan Gaich and Rose Gaich, his
    14  wife (grantee), under the following conditions:
    15         (1)  The parcels conveyed shall be utilized only for
    16     construction of a roadway from Township Route 414 (Maple
    17     Street) to serve adjoining property of the grantee and all
    18     interests in the parcels shall revert to the grantor if no

     1     longer needed for said means of ingress and egress.
     2         (2)  A payment of $3,000 shall be made by the grantee to
     3     the grantor with $1,500 being retained by the grantor for
     4     recreational improvements on the Project 70 park site and
     5     $1,500 being transferred to the Commonwealth of Pennsylvania
     6     for deposit into the Project 70 Land Acquisition Sinking
     7     Fund.
     8     (b)  The document of conveyance shall be prepared by the
     9  Township of Sewickley and filed in the Westmoreland County
    10  Recorder of Deeds Office.
    11     Section 2.  The parcels to be conveyed by the Township of
    12  Sewickley (grantor) to Dan Gaich and Rose Gaich, his wife
    13  (grantee) are more particularly described as follows:
    14     Parcel No. 1 is to be conveyed in fee.
    15     Beginning at a point which is a corner common to land of the
    16  grantor herein and other lands of the grantees herein; thence
    17  from said point and along other lands of the grantees south 81
    18  degrees 31 minutes east a distance of 154.41 feet to a point,
    19  being the true place of beginning; thence from said true place
    20  of beginning and along other lands of the grantees herein, south
    21  81 degrees 31 minutes east a distance of 52.58 feet to a point;
    22  thence from said point and through other lands of the grantor
    23  herein, south 26 degrees 29 minutes 39 seconds west a distance
    24  of 288.13 feet to a point; thence from said point and along
    25  other lands of the grantor herein, south 63 degrees 30 minutes
    26  21 seconds east a distance of 5 feet to a point; thence from
    27  said point and along other lands of the grantor herein, south 26
    28  degrees 29 minutes 39 seconds west a distance of 32.49 feet to a
    29  point; thence from said point and along other lands of the
    30  grantor herein by an arc curving to the right having a radius of

     1  108.50 feet, an arc distance of 13.82 feet to a point; thence
     2  from said point and along other lands of the grantor herein,
     3  north 56 degrees 12 minutes 25 seconds west a distance of 13.50
     4  feet to a point; thence from said point and through other lands
     5  of the grantor herein, north 48 degrees 43 minutes 43 seconds
     6  west a distance of 47.30 feet to a point; thence from said point
     7  and along other lands of the grantor herein, north 63 degrees 30
     8  minutes 21 seconds west a distance of 3.50 feet to a point;
     9  thence from said point and along other lands of the grantor
    10  herein, north 26 degrees 29 minutes 30 seconds east a distance
    11  of 32.49 feet to a point; thence from said point and along other
    12  lands of the grantor herein, south 63 degrees 30 minutes 21
    13  seconds east a distance of 5 feet to a point; thence from said
    14  point and along other lands of the grantor herein, north 26
    15  degrees 29 minutes 39 seconds east a distance of 271.87 feet to
    16  a point, being the place of beginning.
    17     Containing 0.377 acres according to a survey of Richard A.
    18  Sunder, Registered Professional Surveyor, dated the 27th day of
    19  March, 1980.
    20     Parcel No. 2 to be conveyed as a right-of-way.
    21     Beginning at a point at a corner common to the lands of the
    22  grantor herein, and the grantees; thence from said point, south
    23  12 degrees 39 minutes 30 seconds west a distance of 353.15 feet
    24  to a point in Maple Street, a public street in the Village of
    25  Rillton, being the true place of beginning; thence from said
    26  true place of beginning and through other lands of the grantor
    27  herein, north 63 degrees 37 minutes 56 seconds east a distance
    28  of 74.16 feet to a point; thence from said point and by an arc
    29  curving to the left having a radius of 45 feet, an arc distance
    30  of 29.17 feet to a point; thence from said point and through

     1  other lands of the grantor herein, south 63 degrees 30 minutes
     2  21 seconds east a distance of 3.50 feet to a point; thence from
     3  said point and through other lands of the grantor herein, south
     4  48 degrees 43 minutes 43 seconds east a distance of 47.30 feet
     5  to a point; thence from said point and by an arc curving to the
     6  right having a radius of 95 feet, an arc distance of 29.48 feet
     7  to a point; thence from said point and along other lands of the
     8  grantees herein, north 80 degrees 23 minutes 30 seconds west a
     9  distance of 53.37 feet to a point; thence from said point and
    10  along other lands of the grantees herein, south 33 degrees 08
    11  minutes 30 seconds west a distance of 65.93 feet to a point;
    12  thence from said point and through other lands of the grantor
    13  herein, south 63 degrees 37 minutes 56 seconds west a distance
    14  of 34.51 feet to a point in Maple Street; thence from said point
    15  and through Maple Street, north 12 degrees 39 minutes 30 seconds
    16  east a distance of 64.36 feet to a point, the place of
    17  beginning.
    18     Containing 0.114 acres according to a survey of Richard A.
    19  Sunder, Registered Professional Surveyor, dated on the 27th day
    20  of March, 1980.
    21     Both parcels No. 1 and No. 2 being a portion of the 7.404
    22  acre tract of land in the deed from Ella M. Trozzo to the
    23  Township of Sewickley, dated February 21, 1967, and recorded
    24  March 10, 1967 in the Westmoreland County Recorder of Deeds
    25  Office, Deed Book 1954, Page 1035.
    26     Section 3.  This act shall take effect immediately.
