We, the undersigned, Committee of Conference on the part of the House of Representatives and Senate for the purpose of considering House Bill No. 980, entitled: "An act to provide from the General Fund for the expenses of the Executive, Legislative and Judicial Departments of the Commonwealth, the public debt and for the public schools for the fiscal year July 1, 1999, to June 30, 2000, for certain institutions and organizations, and for the payment of bills incurred and remaining unpaid at the close of the fiscal year ending June 30, 1999; * * *; and to provide for the appropriation of Federal funds to the Executive and Judicial Departments of the Commonwealth and for the establishment of restricted receipt accounts for the fiscal year July 1, 1999, to June 30, 2000, and for the payment of bills remaining unpaid at the close of the fiscal year ending June 30, 1999," respectfully submit the following bill as our report: John E. AN ACT 1 To provide from the General Fund for the expenses of the 2 Executive, Legislative and Judicial Departments of the 3 Commonwealth, the public debt and for the public schools for 4 the fiscal year July 1, 1999, to June 30, 2000, for certain 5 institutions and organizations, and for the payment of bills 6 incurred and remaining unpaid at the close of the fiscal year 7 ending June 30, 1999; to provide appropriations from the 8 State Lottery Fund, the Energy Conservation and Assistance 9 Fund, the Hazardous Material Response Fund, The State Stores 10 Fund, the Milk Marketing Fund, the Home Investment Trust 11 Fund, the Emergency Medical Services Operating Fund, the Ben 12 Franklin/IRC Partnership Fund, the Tuition Payment Fund, the 13 Banking Department Fund and the Firearm Records Check Fund to 14 the Executive Department; and to provide appropriations from 15 the Judicial Computer System Augmentation Account to the 16 Judicial Department for the fiscal year July 1, 1999, to June 17 30, 2000; and to provide appropriations from the Motor 18 License Fund for the fiscal year July 1, 1999, to June 30, 19 2000, for the proper operation of the several departments of 20 the Commonwealth and the Pennsylvania State Police authorized 21 to spend Motor License Fund moneys; to provide for the 22 appropriation of Federal funds to the Executive and Judicial 23 Departments of the Commonwealth and for the establishment of 24 restricted receipt accounts for the fiscal year July 1, 1999, 25 to June 30, 2000, and for the payment of bills remaining 26 unpaid at the close of the fiscal year ending June 30, 1999; 27 and to provide for the additional appropriation of Federal 28 and State funds for the Executive Department of the 29 Commonwealth for the fiscal year July 1, 1998, to June 30, 30 1999, and for the payment of bills incurred and remaining 31 unpaid at the close of the fiscal year ending June 30, 1998. 32 TABLE OF CONTENTS 33 PART I. 1 hereby enacts as follows: 2 PART I 3 GENERAL PROVISIONS 4 Section 101. Short title.--This act shall be known and may 5 be cited as the General Appropriation Act of 1999. 6 Section 102. Definitions.--The following words and phrases 7 when used in this act shall have the meanings given to them in 8 this section unless the context clearly indicates otherwise: 9 "Employees." Includes all directors, superintendents, bureau 10 or division chiefs, assistant directors, assistant 11 superintendents, assistant chiefs, experts, scientists, 12 engineers, surveyors, draftsmen, accountants, secretaries, 13 auditors, inspectors, examiners, analysts, statisticians, 14 marshals, clerks, stenographers, bookkeepers, messengers and 15 other assistants in any department, board or commission. 16 "Expenses" and "maintenance." Includes all printing, binding 17 and stationery, food and forage, materials and supplies, 18 traveling expenses, training, motor vehicle supplies and 19 repairs, freight, express and cartage, postage, telephones and 20 telegraph rentals and toll charges, newspaper advertising and 21 notices, public advertising by or through any medium, fuel, 22 light, heat, power and water, minor construction and renovation, 23 repairs or reconstruction of equipment, buildings and 24 facilities, rent of real estate and equipment, premiums on 25 workers' compensation, insurance premiums on policies of 26 liability insurance, insurance premiums on medical payment 27 insurance and surety bonds for volunteer workers, premiums on 28 employee group life insurance and employee and retired employee 29 group hospital and medical insurance, payment of Commonwealth 30 share of Social Security taxes and unemployment compensation 19990H0980B1703 - 10 -
1 costs for State employees, the purchase of replacement or 2 additional equipment and machinery and all other incidental 3 costs and expenses, including payment to the Department of 4 General Services of mileage and other charges for the use of 5 automobiles and rental payments for permanently assigned 6 automobiles and of expenses or costs of services incurred 7 through the Purchasing Fund. The term "expenses" also shall 8 include the medical costs for the treatment of inmates of State 9 institutions when the inmate must be transferred to an outside 10 hospital: Provided, That in no case shall the State institution 11 pay more for patient care than that provided under the State 12 medical assistance program. 13 Section 103. Abbreviations.--The following abbreviations 14 when used in this act shall have the meanings given to them in 15 this section unless the context clearly indicates otherwise: 16 "ARC." State appropriations.--(a) General Fund.--The 16 following sums set forth in this act, or as much thereof as may 17 be necessary, are hereby specifically appropriated from the 18 General Fund to the several hereinafter named agencies of the 19 Executive, Legislative and Judicial Departments of the 20 Commonwealth for the payment of salaries, wages or other 21 compensation and travel expenses of the duly elected or 22 appointed officers and employees of the Commonwealth, for the 23 payment of fees for contractual services rendered, for the 24 purchase or rental of goods and services, printing, public 25 advertising by or through any medium, equipment, land and 26 buildings and for payment of any other expenses, as provided by 27 law or by this act, necessary for the proper conduct of the 28 duties, functions and activities and for the purposes 29 hereinafter set forth for the fiscal year beginning July 1, 30 1999, and for the payment of bills incurred and remaining unpaid 19990H0980B1703 - 12 -
1 at the close of the fiscal year ending June 30, 1999. 2 (b) State Lottery Fund.--The following sums set forth in 3 this act, or as much thereof as may be necessary, are hereby 4 specifically appropriated from the State Lottery Fund to the 5 several hereinafter named agencies of the Executive Department 6 of the Commonwealth for the payment of salaries, wages or other 7 compensation and travel expenses of the duly appointed officers 8 and employees of the Commonwealth, for the payment of fees for 9 contractual services rendered, for the purchase or rental of 10 goods and services and for payment of any other expenses, as 11 provided by law or by this act, necessary for the proper conduct 12 of the duties, functions and activities and for the purposes 13 hereinafter set forth for the fiscal year beginning July 1, 14 1999, and for the payment of bills incurred and remaining unpaid 15 at the close of the fiscal year ending June 30, 1999. 16 (c) Energy Conservation and Assistance Fund.--The following 17 sums set forth in this act, or as much thereof as may be 18 necessary, are hereby specifically appropriated from the Energy 19 Conservation and Assistance Fund to the several hereinafter 20 named agencies of the Executive Department of the Commonwealth 21 for the payment of fees for contractual services rendered, for 22 the purchase or rental of goods and services and for the payment 23 of any other expenses, as provided by law or by this act, 24 necessary for the proper conduct of the duties, functions and 25 activities and for the purposes hereinafter set forth for the 26 fiscal year beginning July 1, 1999, and for the payment of bills 27 incurred and remaining unpaid at the close of the fiscal year 28 ending June 30, 1999. 29 (d) Judicial Computer System Augmentation Account.--The 30 following sums set forth in this act, or as much thereof as may 19990H0980B1703 - 13 -
1 be necessary, are hereby specifically appropriated from the 2 restricted receipt account established within the General Fund, 3 known as the Judicial Computer System Augmentation Account, to 4 the Judicial Department of the Commonwealth for the payment of 5 salaries, wages or other compensation and travel expenses, for 6 the payment of fees for contractual services rendered, for the 7 purchase or rental of goods and services and for the payment of 8 any other expenses, as provided by law or by this act, necessary 9 for the proper conduct of the duties, functions and activities 10 and for the purposes hereinafter set forth for the fiscal year 11 beginning July 1, 1999, and for the payment of bills incurred 12 and remaining unpaid at the close of the fiscal year ending June 13 30, 1999. 14 (e) Emergency Medical Services Operating Fund.--The 15 following sums set forth in this act, or as much thereof as may 16 be necessary, are hereby specifically appropriated from the 17 Emergency Medical Services Operating Fund to the several 18 hereinafter named agencies of the Executive Department of the 19 Commonwealth for the payment of fees for contractual services 20 rendered, for the purchase or rental of goods and services and 21 for the payment of any other expenses, as provided by law or by 22 this act, necessary for the proper conduct of the duties, 23 functions and activities and for the purposes hereinafter set 24 forth for the fiscal year beginning July 1, 1999, and for the 25 payment of bills incurred and remaining unpaid at the close of 26 the fiscal year ending June 30, 1999. 27 (f) The State Stores Fund.--The following sums set forth in 28 this act, or as much thereof as may be necessary, are hereby 29 specifically appropriated from The State Stores Fund to the 30 hereinafter named agency of the Executive Department of the 19990H0980B1703 - 14 -
1 Commonwealth for the payment of salaries, wages or other 2 compensation and travel expenses of the duly appointed officers 3 and employees of the Commonwealth, for the payment of fees for 4 contractual services rendered, for the purchase or rental of 5 goods and services and for the payment of any other expenses, as 6 provided by law or by this act, necessary for the proper conduct 7 of the duties, functions and activities and for the purposes 8 hereinafter set forth for the fiscal year beginning July 1, 9 1999, and for the payment of bills incurred and remaining unpaid 10 at the close of the fiscal year ending June 30, 1999. 11 (g) Motor License Fund.--The following sums, or as much 12 thereof as may be necessary, are hereby appropriated from the 13 Motor License Fund to the hereinafter named agencies of the 14 Executive Department for the payment of salaries, wages and 15 other compensation and travel expenses of the duly elected or 16 appointed officers and employees of the Commonwealth, for 17 contractual services and other expenses necessary for the proper 18 conduct of the duties, functions and activities for the purposes 19 hereinafter set forth for the fiscal year beginning July 1, 20 1999, and for the payment of bills incurred and remaining unpaid 21 at the close of the fiscal year ending June 30, 1999. 22 (h) Aviation Restricted Revenue Account.--The following 23 sums, or as much thereof as may be necessary, are hereby 24 appropriated from the Aviation Restricted Revenue Account in the 25 Motor License Fund to the hereinafter named agencies of the 26 Executive Department for the purposes set forth herein for the 27 fiscal year beginning July 1, 1999, and for the payment of bills 28 incurred and remaining unpaid at the close of the fiscal year 29 ending June 30, 1999. 30 (i) Hazardous Material Response Fund.--The following sums 19990H0980B1703 - 15 -
1 set forth in this act, or as much thereof as may be necessary, 2 are hereby specifically appropriated from the Hazardous Material 3 Response Fund to the several hereinafter named agencies of the 4 Executive Department of the Commonwealth for the payment of fees 5 for contractual services rendered, for the purchase or rental of 6 goods and services and for the payment of any other expenses, as 7 provided by law or by this act, necessary for the proper conduct 8 of the duties, functions and activities and for the purposes 9 hereinafter set forth for the fiscal year beginning July 1, 10 1999, and for the payment of bills incurred and remaining unpaid 11 at the close of the fiscal year ending June 30, 1999. 12 (j) Milk Marketing Fund.--The following sums set forth in 13 this act, or as much thereof as may be necessary, are hereby 14 specifically appropriated from the Milk Marketing Fund to the 15 several hereinafter named agencies of the Executive Department 16 of the Commonwealth for the payment of salaries, wages or other 17 compensation and travel expenses of the duly appointed officers 18 and employees of the Commonwealth, for the payment of fees for 19 contractual services rendered, for the purchase or rental of 20 goods and services and for the payment of any other expenses, as 21 provided by law or by this act, necessary for the proper conduct 22 of the duties, functions and activities and for the purposes 23 hereinafter set forth for the fiscal year beginning July 1, 24 1999, and for the payment of bills incurred and remaining unpaid 25 at the close of the fiscal year ending June 30, 1999. 26 (k) Home Investment Trust Fund.--The following sums set 27 forth in this act, or as much thereof as may be necessary, are 28 hereby specifically appropriated from the Home Investment Trust 29 Fund to the hereinafter named agencies of the Executive 30 Department of the Commonwealth for the payment of salaries, 19990H0980B1703 - 16 -

Block grants.--(a) Appropriation.--The 3 following sums set forth in this act, or as much thereof as may 4 be necessary, are hereby specifically appropriated from the 5 block grant (BG) funds to the several hereinafter named agencies 6 of the Executive Department of the Commonwealth for the 7 purposes, and under the restrictions, for which the funds are 8 provided for the fiscal year beginning July 1, 1999. 9 (b) Small Communities Development Block Grant.--The Small 10 Communities Development Block Grant (SCDBG) is to assist small 11 cities and communities that have a high concentration of 12 impoverished citizens and substandard housing to expand their 13 low-income and moderate-income housing opportunities and to meet 14 community development needs. 15 (c) Community Services Block Grant.--The Community Services 16 Block Grant (CSBG) is to provide a range of services and 17 activities having a measurable and potentially major impact on 18 the causes of poverty in the community or those areas of the 19 community where poverty is a particularly acute problem. In 20 addition, new focus may be placed on the unemployed, both old 21 and new. Local agencies may lower their eligibility requirements 22 for recipients to three months to allow greater flexibility to 23 assure proper consideration of each recipient. 24 (d) Preventive Health and Health Services Block Grant.--The 25 Preventive Health and Health Services Block Grant (PHHSBG) is 26 for the provision of preventive health and other health services 27 related to emergency medical systems, health initiative grants, 28 comprehensive public health, hypertension, fluoridation, health 29 education, risk reduction, home health, rape crisis and domestic 30 violence services. 19990H0980B1703 - 20 -
1 (e) Maternal and Child Health Services Block Grant.--The 2 Maternal and Child Health Services Block Grant (MCHSBG) is to 3 enable states to maintain and strengthen their leadership in 4 planning, promoting, coordinating and evaluating health care for 5 pregnant women, mothers, infants and children, and children with 6 special health care needs, and in providing health services for 7 mothers and children who do not have access to adequate health 8 care. 9 (f) Low-Income Home Energy Assistance Block Grant.--The Low- 10 Income Home Energy Assistance Block Grant (LIHEABG) is to help 11 lessen the impact of the high cost of energy on low-income 12 families and individuals, including energy efficiency grants for 13 low-income dwellings. No less than 15% of the LIHEABG funds 14 received shall be used for weatherization. LIHEABG funds 15 received pursuant to a Presidential release of weather-related 16 contingency funds shall be exempt from the 15% requirement if 17 the weather emergency has an impact in Pennsylvania. Unexpended 18 weatherization funds which would result in LIHEABG funds being 19 returned to the Federal Department of Health and Human Services 20 may be spent for assistance grants at the discretion of the 21 Secretary of the Budget. The Secretary of the Budget shall 22 notify the majority chairman and the minority chairman of the 23 Appropriations Committee of the Senate and the majority chairman 24 and the minority chairman of the Appropriations Committee of the 25 House of Representatives of the intent to reallocate any such 26 funds ten days prior to any reallocation. 27 (g) Social Services Block Grant.--The Social Services Block 28 Grant (SSBG) is for the provision of social services to eligible 29 persons. 30 (h) Mental Health Services Block Grant.--The Mental Health 19990H0980B1703 - 21 -

Prior laws unaffected.--This act is not 12 intended to be inconsistent with or to repeal any provision of 13 any act enacted at this or any prior session of the General 14 Assembly regulating the purchase of supplies, the ordering of 15 printing and binding, the purchase, maintenance and use of 16 automobiles, the method of making payments from the State 17 Treasury for any purpose or the functioning of any 18 administrative department, board or commission. 19 Section 1792. Compliance with other law before funds 20 available.--No appropriation made by this part to any 21 department, board, commission or agency of the Executive 22 Department shall be available unless and until the department, 23 board, commission or agency has complied with sections 615 and 24 616 of the act of April 9, 1929 (P.L.177, No.175), known as The 25 Administrative Code of 1929. 26 Section 1793. 1 Section 1794. Minority business set-asides.--(a) Each 2 department or other instrumentality of the Commonwealth listed 3 in Subpart B authorized to contract for buildings, highways, 4 commodities, equipment, supplies or services shall report to the 5 General Assembly all information pertinent to anticipated 6 procurement needs at the beginning of each fiscal year and each 7 fiscal quarter thereafter. 8 (b) As used in this section, the term "minority business" 9 means a minority business enterprise as defined in the act of 10 July 22, 1974 (P.L.598, No.206), known as the Pennsylvania 11 Minority Business Development Authority Act. 12 Section 1795. Appropriation of funds from miscellaneous 13 sources.--(a) In addition to the amounts appropriated by this 14 part, moneys received in payment for food and household supplies 15 furnished to employees and other persons, except inmates, by an 16 institution, and moneys received from the proceeds from the sale 17 of any products of the soil, meats, livestock, timber or other 18 materials sold by the department shall be paid into the General 19 Fund and are hereby appropriated out of the General Fund to the 20 several respective institutions for the operation and 21 maintenance of the institutions. 22 (b) In addition to the amounts appropriated by this part, 23 all moneys received from any other source, except the Federal 24 Government, as contributions for the programs provided herein or 25 as payment for services or materials furnished by one 26 institution to another, except those collections designated as 27 revenues, shall be paid into the General Fund and are hereby 28 appropriated out of the General Fund for the purposes of the 29 respective appropriations. 30 (c) In addition to any funds specifically appropriated by 19990H0980B1703 - 214 -
1 this part, all moneys received by a department or agency of the 2 Commonwealth from any other sources, except the Federal 3 Government, as contributions or supplements to the department or 4 agency for a program or administration of an act included in 5 this part shall be paid into the General Fund and credited to 6 the appropriation for that program or administration of the act. 7 Section 1796. Lapsing of unused funds.--(a) Except as 8 otherwise provided by law or subsection (b), that part of all 9 appropriations in Part XVII unexpended, uncommitted or 10 unencumbered as of June 30, 1999, shall automatically lapse as 11 of that date. 12 (b) The appropriations in Subpart B to: 13 (1) The Treasury Department for expenses for Chapter 93 14 proceedings shall be a two-year continuing appropriation. 15 (2) The Department of Community and Economic Development 16 for urban development shall be a two-year continuing 17 appropriation. 18 Section 1797. Construction with prior appropriation acts.-- 19 Any appropriation in Subpart B of this part which is the same or 20 similar to any appropriation in the act of April 22, 1998 (P.L. 21 , No.6A), known as the General Appropriation Act of 1998, shall 22 replace that appropriation. Any distribution of funds under 23 section 240 of the General Appropriation Act of 1998 shall be in 24 addition to the amounts in this part. The Federal appropriation 25 in section 1719 to the Department of Public Welfare for "Child 26 Welfare - Title IV-E - Child Welfare" includes the additional 27 funds provided in the act of December 15, 1998 (P.L.949, No. 28 126), entitled "An act amending Title 42 (Judiciary and Judicial 29 Procedure) of the Pennsylvania Consolidated Statutes, further 30 providing for the number of judges in the courts of common 19990H0980B1703 - 215 -
1 pleas, for jurisdiction and venue of the Philadelphia Municipal 2 Court and for juvenile proceedings; providing for good Samaritan 3 civil immunity for use of an automated external defibrillator; 4 and making appropriations." 5 Section 1798. Deduction of expended appropriations under 6 prior law.--Any money which has been appropriated and expended 7 under the act of April 22, 1998 (P.L. , No.6A), known as the 8 General Appropriation Act of 1998, shall be deducted from the 9 corresponding appropriation in this part. 10 PART XVIII 11 SPECIAL PROVISIONS FOR FEDERAL FUNDS 12 FOR 1999-2000 13 Section 1801. General Fund repository for Federal funds.-- 14 All moneys received from the Federal Government as contributions 15 or supplements to the departments or agencies of the 16 Commonwealth or the programs herein provided shall be paid into 17 the General Fund. 18 Section 1802. Limitation on encumbering or spending Federal 19 funds.--Federal funds shall be encumbered or spent only to the 20 extent that such funds are estimated as being available during 21 the fiscal year of the Commonwealth. 22 Section 1803. Appropriation of prior unspent Federal 23 funds.--Any Federal money which has been previously appropriated 24 by the General Assembly and authorized or allocated by the 25 Federal Government but remains unspent from prior fiscal years 26 and will not be renewed for fiscal year 1999-2000 is hereby 27 appropriated. 28 Section 1804. Subgrants between Federal fund 29 appropriations.--With the exception of Federal money received 30 under JTPA and SSBG, subgrants may be made between 19990H0980B1703 - 216 -
1 appropriations without further approval of the General Assembly. 2 The Secretary of the Budget shall submit a list of subgrants to 3 the Chairmen and minority chairmen of the House and Senate 4 Appropriations Committees quarterly. No subgrant to a State 5 agency, however, may be made from a restricted receipt account 6 without a specific appropriation by the General Assembly. 7 Section 1805. Utilization of emergency Federal funds.--(a) 8 Federal funds available for costs and damages resulting from 9 natural disasters or civil disobedience may be added to an 10 appropriation contained in this act or to funds appropriated or 11 may be used for the purposes prescribed by the Federal 12 Government. 13 (b) In addition to the moneys appropriated by this act, all 14 moneys received from the Federal Government for the purpose of 15 disaster assistance or relief shall be paid into the General 16 Fund and are hereby appropriated out of the General Fund to the 17 departments, boards, commissions or agencies designated by the 18 Governor. 19 (c) In the event of any emergency situation in which the 20 General Assembly cannot act in sufficient time, the Governor is 21 authorized through executive authorization to provide up to 22 $10,000,000 in Federal funds to alleviate the emergency 23 situation. For the purposes of this section, "emergency" is 24 defined as any situation in which there is a chance of or which 25 may result in substantial human suffering. 26 Section 1806. Transfer of funds from TANFBG to CCDFBG and 27 SSBG.--In accordance with Federal law which permits the transfer 28 of funds from the TANFBG to the CCDFBG and SSBG in amounts that 29 do not exceed 30% in total and limits the transfer to SSBG to 30 not more than 10% of the 30%, the Department of Public Welfare, 19990H0980B1703 - 217 -
1 upon approval of the Secretary of the Budget, may make such 2 transfers of funds provided that any such transfer will not 3 result in a deficit in any appropriation from which funds are 4 transferred. The Secretary of the Budget shall provide 5 notification of any such transfers to the majority chairman and 6 the minority chairman of the Appropriations Committee of the 7 Senate and the majority chairman and minority chairman of the 8 Appropriations Committee of the House of Representatives ten 9 days prior to any transfer which shall also include 10 certification that such transfer will not result in a deficit in 11 any appropriation. 12 PART XXIX 13 MISCELLANEOUS PROVISIONS FOR 1999-2000 14 Section 1901. Prior laws unaffected.--Except as provided in 15 section 253, this act is not intended to be inconsistent with or 16 to repeal any provision of any act enacted at this or any prior 17 session of the General Assembly regulating the purchase of 18 supplies, the ordering of printing and binding, the purchase, 19 maintenance and use of automobiles, the method of making 20 payments from the State Treasury for any purpose or the 21 functioning of any administrative department, board or 22 commission. 23 Section 1902. 1 committing funds.--Funds available to agencies, boards, 2 departments, commissions, or other governmental entities under 3 this act for the procurement of supplies, services or 4 construction shall not be available for payment of, or to be 5 committed to or encumbered for payment of, any such procurement 6 unless and until the agency, board, department or other 7 governmental entity has complied with all of the requirements 8 applicable to the procurement that are set out in 62 Pa.C.S. 9 (relating to procurement) and in the policies, procedures and 10 regulations instituted in accordance with that code. 11 Section 1904. Lapsing of unused funds.--(a) Except as 18 otherwise provided by law or by this section, that part of all 19 appropriations in Parts II, III, IV, V, VI, VII, VIII, IX, X, 20 XI, XII, XIII, XIV and XV unexpended, uncommitted or 21 unencumbered as of June 30, 2000, shall automatically lapse as 22 of that date. 23 (b) The appropriations in Part II to the Legislative 24 Department shall be continuing appropriations. 25 (c) The appropriation in Part II to the Department of 26 Agriculture for the supplemental Agricultural Easement Purchase 27 Program shall be a two-year continuing appropriation. 28 Section 1907. Appellate courts appropriation contingency.-- 29 The funds appropriated in Part II to the Supreme, Superior and 30 Commonwealth Courts for justice and judge expenses are 19990H0980B1703 - 220 -
1 contingent upon a vouchered expense account plan being continued 2 by the Supreme Court. 3 Section 1908. Transfer of excess funds.--The Governor may 4 transfer any excess money in those funds receiving proceeds of 5 Commonwealth of Pennsylvania general obligation bonds in excess 6 of the amount necessary for the purposes for which the bonds 7 were issued to the appropriate sinking fund for payment of debt 8 service due on outstanding bonds. If such excess funds, together 9 with any available balance, exceed the amount of debt service 10 remaining to be paid, the funds shall be transferred to the 11 General Fund or to the appropriate special fund responsible for 12 such debt service. 13 Section 1909. Transfer of funds by the Supreme Court.--(a) 14 The Supreme Court may transfer any excess funds appropriated in 15 sections 281, 285, 286, 287, 288, 289, 290, 291 and 292 to the 16 Judicial Department in Part II to the Judicial Computer 17 Augmentation Account during the month of June 2000. No transfer 18 may create or increase a deficiency in the appropriation from 19 which the transfer is made. Whenever the Supreme Court makes a 20 transfer under this subsection, the Supreme Court shall give 21 written notification to the Secretary of the Budget and chairman 22 and minority chairman of the Senate Committee on Appropriations 23 and the chairman and the minority chairman of the House of 24 Representatives Committee on Appropriations ten days prior to 25 any transfer which shall also include certification that such 26 transfer will not result in a deficit in any appropriation. 27 (b) The Supreme Court may transfer funds appropriated in 28 section 281 between the line items in that section provided that 29 no transfer may create or increase a deficiency in the 30 appropriation from which the transfer is made. 1 Supreme Court makes a transfer under this subsection, the 2 Supreme Court shall give written notification to the Secretary 3 of the Budget and the chairman and minority chairman of the 4 Senate Committee on Appropriations and the chairman and the 5 minority chairman of the House of Representatives Committee on 6 Appropriations ten days prior to any transfer which shall also 7 include certification that such transfer will not result in a 8 deficit in any appropriation. 9 Section 1910. Transfer from Hazardous Sites Cleanup Fund.-- 10 The sum of $12,000,000 is transferred from the Hazardous Sites 11 Cleanup Fund to the Industrial Sites Cleanup Fund. 12 Section 1911. Transfer from Pennsylvania Minority Business 13 Development Fund.--The sum of $1,000,000 is transferred from the 14 Pennsylvania Minority Business Development Fund to the Small 15 Business First Fund. 16 Section 1912. Transfer to Tax Stabilization Reserve Fund.-- 17 If sufficient funds are available, the sum of $150,000,000 shall 18 be transferred to the Tax Stabilization Reserve Fund from the 19 ending balance at the close of the fiscal year ending June 30, 20 1999. 21 PART XX 22 EFFECTIVE DATE 23 Section 2001. Effective date.--This act shall take effect as 24 follows: 25 (1) Part XVII shall take effect immediately. 26 (2) This section shall take effect immediately. 27 (3) The remainder of this act shall take effect July 1, 28 1999, or immediately, whichever is later.
