A RESOLUTION

Urging the Congress of the United States to adopt as part of the

2

Federal transportation reauthorization bill a provision

3

requiring 60% approval by a state legislature prior to

4

flexing of Federal highway and bridge funds to transit

5

agencies.

WHEREAS, On February 28, 2005, the Governor of the

7

Commonwealth of Pennsylvania shifted, or flexed, approximately

8

$68 million in Federal funds earmarked for highway and bridge

9

repairs to the Southeastern Pennsylvania Transportation

10

Authority and the Port Authority of Allegheny County; and

11

WHEREAS, On February 28, 2005, the Governor of the

12

Commonwealth of Pennsylvania directed the Commonwealth's

13

metropolitan planning organizations to flex an additional $344

14

million in Federal funds earmarked for highway and bridge

15

repairs to the Commonwealth's transit agencies; and

16

WHEREAS, This flexing of funds was made available to this

17

Commonwealth's transit agencies until November 2006; and

18

WHEREAS, As a result these flexed Federal funds were not

19

available for their original intended purposes; and

WHEREAS, The Governor of the Commonwealth of Pennsylvania did

2

not seek authorization or approval of the General Assembly in

3

flexing these funds; therefore be it

4

RESOLVED, That the House of Representatives of the

5

Commonwealth of Pennsylvania urge Congress to adopt as part of

6

the Federal transportation reauthorization bill a provision

7

requiring 60% approval by a state legislature prior to flexing

8

of Federal highway and bridge funds to transit agencies; and be

9

it further

RESOLVED, That a copy of this resolution be transmitted to

11

the presiding officers of each house of Congress and to each

12

member of the Pennsylvania Congressional Delegation.
