| AN ACT |
| |
1 | Amending Title 42 (Judiciary and Judicial Procedure) of the |
2 | Pennsylvania Consolidated Statutes, further providing for |
3 | tolling of limitations in civil actions because of infancy, |
4 | insanity or imprisonment. |
5 | The General Assembly of the Commonwealth of Pennsylvania |
6 | hereby enacts as follows: |
7 | Section 1. Section 5533(b) of Title 42 of the Pennsylvania |
8 | Consolidated Statutes is amended by adding a paragraph to read: |
9 | § 5533. Infancy, insanity or imprisonment. |

11 | (b) Infancy.-- |
12 | * * * |
13 | (3) Notwithstanding any other provision of law, a civil |
14 | action arising from childhood sexual abuse which is subject |
15 | to paragraph (2) but would be barred as of July 1, 2011, |
16 | solely because the statute of limitations has expired, is |
17 | revived and such a civil action may be commenced within two |
18 | years of July 1, 2011. Nothing in this paragraph shall be |

1 | construed to alter the applicable statute of limitations |
2 | period of a civil action arising from childhood sexual abuse |
3 | which is not time barred as of July 1, 2011. |
4 | Section 2. This act shall take effect in 60 days. |
