AN ACT 1 Repealing the act of April 18, 1949 (P.L.604, No.128), entitled 2 "An act to promote the welfare of the people of the 3 Commonwealth; creating a State Highway and Bridge Authority 4 as a body corporate and politic with power to construct, 5 reconstruct, improve, maintain, equip, furnish, and operate 6 highway and bridge projects, and roadside rests, and to lease 7 the same, and to fix and collect fees, rentals, and charges 8 for the use thereof; authorizing and regulating the issuance 9 of bonds by said Authority, and providing for the payment of 10 such bonds, and the rights of the holders thereof; and to 11 enter into agreements with the Government of the United 12 States or any Federal agency; and authorizing the Department 13 of Highways to grant, assign, convey, or lease to the 14 Authority lands, easements, or rights of way of the 15 Commonwealth and interests therein, and to acquire lands 16 therefor; authorizing said Authority and the Department of 17 Highways to enter into agreements providing for mutual 18 cooperation in furtherance of the construction of any project 19 hereby authorized; granting the right of eminent domain; 20 empowering said Authority to see and convey projects and 21 property to the Commonwealth; and providing that no debt of 22 the Commonwealth or any of its political subdivisions shall 23 be incurred in the exercise of any of the powers granted by 24 this act; and making an appropriation," providing the 25 transfer of certain functions, powers, duties and property to 26 the Department of Transportation. 27 The General Assembly of the Commonwealth hereby enacts as 28 follows: 29 Section 1. The act of April 18, 1949 (P.L.604, No.128),
1 known as the "State Highway and Bridge Authority Act," is 2 repealed. 3 Section 2. (a) All personnel, allocations, appropriations, 4 agreements, leases, claims, demands and causes of action of any 5 nature whether or not subject to litigation on the date of this 6 act, equipment, files, records, classified data files, plans, 7 maps, air photographs, and all other materials which are used, 8 employed or expended in connection with the duties, powers or 9 functions of the State Highway and Bridge Authority are hereby 10 transferred by this act to the Department of Transportation with 11 the same force and effect as if the appropriations had been made 12 to and said items had been the property of the Department of 13 Transportation in the first instance and if said contracts, 14 agreements, leases and obligations had been incurred or entered 15 into by the Department of Transportation. 16 (b) All personnel transferred to the Department of 17 Transportation from the State Highway and Bridge Authority 18 pursuant to this act shall retain any civil service or other 19 employment status assigned to said personnel in the authority 20 prior to the effective date of this act. 21 Section 3. Nothing contained in this act shall be construed 22 to affect any project of the State Highway and Bridge Authority 23 upon which any of the proceeds of its bonds have been or may be 24 expended. 25 Section 4. The State Highway and Bridge Authority organized 26 and existing pursuant to the act of April 18, 1949 (P.L.604, 27 No.128), known as the "State Highway and Bridge Authority Act" 28 shall continue in existence and maintain the rights vested in 29 the authority until all State Highway and Bridge Authority bonds 30 at any time issued, together with the interest thereon, are 19810H0794B0852 - 2 -
1 fully met and discharged, at which time the State Highway and 2 Bridge Authority is abolished. During the interim period of its 3 existence, all the functions, powers and duties of the authority 4 shall be performed and exercised by the Department of 5 Transportation. 6 Section 5.
