AN ACT 1 Amending the act of April 9, 1929 (P.L.177, No.175), entitled 2 "An act providing for and reorganizing the conduct of the 3 executive and administrative work of the Commonwealth by the 4 Executive Department thereof and the administrative 5 departments, boards, commissions, and officers thereof, 6 including the boards of trustees of State Normal Schools, or 7 Teachers Colleges; abolishing, creating, reorganizing or 8 authorizing the reorganization of certain administrative 9 departments, boards, and commissions; defining the powers and 10 duties of the Governor and other executive and administrative 11 officers, and of the several administrative departments, 12 boards, commissions, and officers; fixing the salaries of the 13 Governor, Lieutenant Governor, and certain other executive 14 and administrative officers; providing for the appointment of 15 certain administrative officers, and of all deputies and 16 other assistants and employes in certain departments, boards, 17 and commissions; and prescribing the manner in which the 18 number and compensation of the deputies and all other 19 assistants and employes of certain departments, boards and 20 commissions shall be determined," requiring certain purchases 21 to be made from domestic bidders; and making editorial 22 changes. 23 The General Assembly of the Commonwealth of Pennsylvania 24 hereby enacts as follows: 25 Section 1. Section 2403(c) and (g) of the act of April 9, 26 1929 (P.L.177, No.175), known as The Administrative Code of
1 1929, amended June 21, 1937 (P.L.1865, No.373) and June 12, 1951 2 (P.L.516, No.133), are amended to read: 3 Section 2403. Standards and Purchases.--The Department of 4 General Services shall have the power, and its duty shall be: 5 * * * 6 (c) To enter into contracts with the lowest responsible 7 domestic bidder for the purchase of all other furniture, 8 materials or supplies requested by the Legislative, and other 9 departments of the State Government, except as otherwise 10 provided by this act, and except that contracts for the purchase 11 of steel for use in the manufacture of vehicle registration 12 plates may be let on the basis of the market price thereof on 13 date of delivery. All such contracts shall be approved by the 14 Governor, and signed on behalf of the Commonwealth by the 15 Secretary of [Property and Supplies] General Services, who shall 16 also, with the approval of the [Department of Justice] Attorney 17 General, prescribe rules and regulations for the submission of 18 bids, awards, forms of contracts and other matter related 19 thereto. As used in this section, the term "domestic bidder" 20 means an individual, corporation, trust, partnership, limited 21 partnership, incorporated or unincorporated association or other 22 entity doing business in the United States of America that 23 supplies goods produced by human or mechanical effort where at 24 least fifty per centum (50%) of the cost of its material or 25 component parts were produced, manufactured or assembled in the 26 United States of America. 27 * * * 28 (g) To authorize any other department, or any board or 29 commission, to make direct purchases in the field, not exceeding 30 a specified amount, but the department shall require records of 19850H0775B0875 - 2 -
1 all such purchases to be transmitted to it periodically in such
2 form as it may prescribe. In so far as practicable, purchases
3 under this paragraph shall be made from contractors having
4 effective supplies contracts with the Department of [Property
5 and Supplies] General Services, and shall be in accordance with
6 applicable specifications in such contracts, otherwise such
7 purchases shall be made from the lowest of at least two bidders.
