                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," providing for a school breakfast
     6     program.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  The act of March 10, 1949 (P.L.30, No.14), known
    10  as the Public School Code of 1949, is amended by adding sections
    11  to read:
    12     Section 1337.1.  School Breakfast Program.--(a)  Each school
    13  district in this Commonwealth is encouraged to make the benefits
    14  of the School Breakfast Program provided by the Child Nutrition
    15  Act of 1966 (Public Law 89-462, 42 U.S.C. § 1771 et seq.)
    16  available to all students at all grade levels.
    17     (b)  Beginning with the school year 1999-2000, each school
    18  food authority which participates in the School Lunch Program


     1  provided by the National School Lunch Act (60 Stat. 230, 42
     2  U.S.C. § 1751 et seq.) may receive a financial incentive from
     3  the Commonwealth to expand the daily participation rate of its
     4  students in the School Breakfast Program.
     5     (c)  Financial incentives shall be made from funds annually
     6  appropriated by the General Assembly to the Department of
     7  Education for school food services.
     8     (d)  Financial incentives for the school year 1999-2000 shall
     9  be in the following amounts:
    10     (1)  Each school building which participates in the School
    11  Lunch Program and School Breakfast Program with student
    12  participation rates in the School Breakfast Program of less than
    13  twenty (20) per centum of enrollment shall receive
    14  reimbursements of eight cents (8¢) per lunch served and ten
    15  cents (10¢) per breakfast served.
    16     (2)  Each school building with student participation rates in
    17  the School Breakfast Program of twenty (20) per centum or more
    18  of enrollment shall receive reimbursements of ten cents (10¢)
    19  per lunch served and ten cents (10¢) per breakfast served.
    20     (3)  Each school building which participates only in the
    21  School Lunch Program shall receive a reimbursement of six cents
    22  (6¢) per lunch served.
    23     (e)  For the 2000-2001 school year, and each school year
    24  thereafter, financial incentives from the Commonwealth under
    25  this section shall be made and determined by the Secretary of
    26  Education, except that these financial incentives shall be no
    27  less than the amounts established in this section.
    28     (f)  The financial incentives under this section shall be
    29  paid to school food authorities during the school year in which
    30  they are earned, based on reports submitted to the Department of

     1  Education.
     2     (g)  For the purposes of this section, "school food
     3  authority" shall mean the governing body which is responsible
     4  for the administration of one or more schools, and has the legal
     5  authority to operate a food program therein or be otherwise
     6  approved by the Food and Nutrition Service of the United States
     7  Department of Agriculture to operate the food program.
     8     Section 1337.2.  Technical Support Services to Expand
     9  Nutrition Opportunities.--(a)  The Department of Education shall
    10  provide technical support services to assist school districts in
    11  developing and expanding school breakfast programs. These
    12  support services shall include, but not be limited to,
    13  compilation of districts' successful approaches to overcoming
    14  barriers to program development.
    15     (b)  The department shall provide technical support services
    16  to assist school districts in developing or enhancing
    17  nutritional education programs. These support services shall
    18  include, but not be limited to, assistance in seeking grant
    19  funds.
    20     Section 2.  Section 1513 of the act is amended to read:
    21     Section 1513.  Physiology and Hygiene.--Physiology and
    22  hygiene, which shall in each division of the subject so pursued
    23  include special reference to the effect of alcoholic drinks,
    24  stimulants, and narcotics upon the human system, and which shall
    25  also include special reference to tuberculosis and its
    26  prevention, shall be introduced and studied as a regular branch
    27  by all pupils in all departments of the public schools, and in
    28  all educational institutions supported wholly or in part by
    29  appropriations from this Commonwealth. Each school district is
    30  encouraged to provide nutrition education to all students at all

     1  grade levels.
     2     Section 3.  This act shall take effect immediately.
