AN ACT 1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania 2 Consolidated Statutes, further providing for drug trafficking 3 sentencing and penalties. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 7508(a) of Title 18 of the Pennsylvania 7 Consolidated Statutes is amended by adding a paragraph to read: 8 § 7508. Drug trafficking sentencing and penalties. 9 (a) General rule.--Notwithstanding any other provisions of 10 this or any other act to the contrary, the following provisions 11 shall apply: 12 * * * 13 (7) A person who is convicted of violating section 14 13(a)(14), (30) or (37) of The Controlled Substance, Drug, 15 Device and Cosmetic Act, in or within 1,000 feet of any
1 public housing shall, upon conviction, be sentenced to a 2 mandatory minimum term of imprisonment of one year total 3 confinement, which sentence shall be in addition to any other 4 penalty provided by law. For purposes of this paragraph, the 5 term "public housing" shall mean any building or group of 6 buildings owned or operated by a housing authority organized 7 pursuant to the act of May 28, 1937 (P.L.955, No.265), known 8 as the Housing Authorities Law, and which provides at least 9 50 units. 10 * * * 11 Section 2.
