        SENATOR MELLOW, ENVIRONMENTAL RESOURCES, IN SENATE, AS AMENDED,
           DECEMBER 14, 1977

                                     AN ACT

     1  Amending the act of June 3, 1937 (P.L.1225, No.316), entitled
     2     "An act concerning game and other wild birds and wild
     3     animals; and amending, revising, consolidating, and changing
     4     the law relating thereto," further regulating the use of
     5     recorded calls or sounds, or electronically amplified
     6     imitations of calls or sounds for use in hunting any wild
     7     birds or wild animals.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Subsection (g) of section 704, act of June 3,
    11  1937 (P.L.1225, No.316), known as "The Game Law," added July 3,
    12  1963 (P.L.208, No.118), is amended to read:
    13     Section 704.  Unlawful Methods of Hunting.--* * *
    14                        (g)  Unlawful Sounds
    15     It [is] shall be unlawful for any person to hunt for, catch,
    16  take, kill or wound, or attempt to catch, take, kill or wound
    17  wild turkeys, FOX OR CROWS by the use or aid of recorded calls    <--
    18  or sounds or recorded or electronically amplified imitation of
    19  calls or sounds of any description. The commission shall be       <--
    20  authorized, by resolution, to adopt rules and regulations

     1  governing the use of recorded calls or sounds or recorded or
     2  electronically amplified imitation of calls or sounds of any
     3  description for hunting, catching, taking, killing or wounding,
     4  or attempting to catch, take, kill or wound any other wild bird
     5  or wild animal regardless of classification.
     6     A person violating a provision of this subsection or a rule
     7  or regulation adopted thereunder shall, upon conviction, or upon
     8  signing an acknowledgment of guilt, be assessed the penalties
     9  and costs for each offense as set forth in subsection (q) of
    10  section 731.
    11     Section 2.  This act shall take effect immediately.
