AN ACT
Amending Title 61 (Prisons and Parole) of the Pennsylvania
Consolidated Statutes, in preliminary provisions, further
providing for definitions; and, in miscellaneous provisions,
providing for voluntary posthumous organ donation by inmates.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 102 of Title 61 of the Pennsylvania
Consolidated Statutes is amended by adding a definition to read:
§ 102. Definitions.
The following words and phrases when used in this title shall
have the meanings given to them in this section unless the
context clearly indicates otherwise:
"Anatomical gift." A donation of all or part of a human body
to take effect after the donor's death for the purpose of
transplantation, therapy, research or education.

Section 2. Title 61 is amended by adding a section to read:
§ 5907. Organ donation by inmates.

(a) Information to be provided.--Upon intake, the department
shall make available to each inmate a document of gift form
which will allow the inmate to indicate the inmate's desire to
make an anatomical gift if the inmate dies while in the custody
of the department.
(b) Recordkeeping.--If an inmate indicates a desire to make
an anatomical gift, the department shall maintain a record of
the inmate's document of gift form.
(c) Release of information.--In the event that an inmate
dies while in the custody of the department, the department
shall release the inmate's document of gift form.
(d) Policy.--The department shall establish policy and may
promulgate regulations necessary to carry out the provisions of
this section.
(e) Construction.--Nothing in this section shall be
construed to authorize the reduction of an inmate's term of
imprisonment on the basis of the inmate indicating a desire to
make an anatomical gift.
Section 3. This act shall take effect in 60 days.
