                                  A RESOLUTION

     1  Amending House Rule RULES 1 AND 14.                               <--

     2     RESOLVED, THAT THE SECOND PARAGRAPH OF HOUSE RULE 1 BE         <--
     3  AMENDED TO READ:
     4                               RULE 1
     5                         SPEAKER PRESIDING

     7     AS PRESIDING OFFICER AND IN ACCORDANCE WITH ARTICLE II § 2 OF
     8  THE CONSTITUTION OF PENNSYLVANIA AND THE ACT OF JUNE 3, 1937
     9  (P.L.1333, NO.320), KNOWN AS THE PENNSYLVANIA ELECTION CODE,
    10  WITHIN TEN DAYS AFTER THE OCCURRENCE OF A VACANCY THE SPEAKER
    11  SHALL ISSUE A WRIT FOR A SPECIAL ELECTION TO BE HELD ON A DATE
    12  WHICH SHALL OCCUR ON OR BEFORE THE DATE OF THE FIRST PRIMARY,
    13  MUNICIPAL OR GENERAL ELECTION WHICH OCCURS NOT LESS THAN 60 DAYS
    14  AFTER THE ISSUANCE OF THE WRIT. THE SPEAKER SHALL NOT BE
    15  REQUIRED TO ISSUE A WRIT OF ELECTION IF THE ELECTION CANNOT BE
    16  SCHEDULED UNTIL AFTER THE GENERAL ELECTION; NOR SHALL THE


     1  SPEAKER BE REQUIRED TO SCHEDULE AN ELECTION FOR A VACANCY WHICH
     2  OCCURS IN THE YEAR FOLLOWING THE OFFICIAL REPORTING OF THE
     3  FEDERAL DECENNIAL CENSUS.

     5     RESOLVED, That the 12th, 13th and 17th paragraphs of House
     6  Rule 14 be amended to read:
     7                              RULE 14
     8                  Members' and Employees' Expenses
     9     * * *
    10     All monthly reports filed on disbursements made or debts
    11  incurred by any officer or member or employee from
    12  appropriations made to the House or to a member or nonmember
    13  officer under any General Appropriation Act, and the
    14  documentation for each disbursement, shall be public information
    15  and shall be available for public inspection during regular
    16  business hours in the office of the Chief Clerk. The Chief Clerk
    17  shall prescribe reasonable rules and regulations for inspection
    18  of such reports but in no case shall inspection be denied to any
    19  person for a period exceeding 48 hours (excluding Saturdays and
    20  Sundays) from the time a written request has been submitted to
    21  the Chief Clerk. Photocopies of such reports shall be made
    22  available upon request to a member at no charge or to the public
    23  for a duplication fee as may be fixed by the Chief Clerk. Such
    24  reports shall be made available to a member or to the public on
    25  or before the last day of the month next succeeding the month in
    26  which the report was filed.
    27     All vouchers and requisitions relating to all expenditures,
    28  expenses, disbursements and other obligations out of all
    29  appropriated funds of the House, and the documentation
    30  evidencing payment of the vouchers and requisitions, shall be

     1  available for public inspection during regular business hours in
     2  the office of the Chief Clerk or at such other location within
     3  the Capitol as the Chief Clerk shall prescribe. Nothing in this
     4  rule shall require release of any information deemed
     5  confidential, including, but not limited to, a telephone number,
     6  a credit card number and a Social Security number.

     8     All expenditures of funds appropriated to the House or to a
     9  member or nonmember officer shall be subject to the expenditure
    10  guidelines established by the Rules Committee. The Rules
    11  Committee shall establish standards regarding documentation
    12  evidencing payment out of any appropriations account made to the
    13  House or to a member or nonmember officer.
    14     RESOLVED, That the amendment of the 12th, 13th and 17th
    15  paragraphs of House Rule 14 apply to documentation for
    16  disbursements made after December 31, 2001, and to reports of
    17  such disbursements.
