AN ACT 1 Amending the act of May 23, 1945 (P.L.903, No.362), entitled "An 2 act authorizing cities of the third class to establish an 3 optional retirement system for officers and employes 4 independently of any pension system or systems existing in 5 such cities," providing for certain military service credit 6 for employe retirement other than city-paid firemen and 7 police. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. Section 12, act of May 23, 1945 (P.L.903, 11 No.362), entitled "An act authorizing cities of the third class 12 to establish an optional retirement system for officers and 13 employes independently of any pension system or systems existing 14 in such cities," is amended to read: 15 Section 12. (a) The time of service herein specified shall 16 be computed from the time of the first or original service to 17 the city, and need not be continuous. 18 (b) With the approval of council, all members of the pension 19 fund who are contributors and who served in the armed forces of 20 the United States subsequent to September 1, 1940, and who were
1 not members of the pension fund prior to such military service, 2 shall be entitled to have full service credit for each year or 3 fraction thereof, not to exceed five (5) years of such service 4 upon their payment to the pension fund of an amount equal to 5 that which they would have paid had they been members during the 6 period for which they desire credit, and their payment to such 7 fund of an additional amount as the equivalent of the 8 contributions of the city plus any interest the city would have 9 been required to pay on the contributions on account of such 10 military service: Provided, That the member has three (3) years 11 of city service subsequent to such military service: Provided, 12 further, That he is not entitled to receive, eligible to receive 13 now or in the future, or is receiving retirement benefits for 14 such service under a retirement system administered and wholly 15 or partially paid for by any other governmental agency. 16 Section 2.
