AN ACT

Amending Title 51 (Military Affairs) of the Pennsylvania

2

Consolidated Statutes, in veterans' pensions and benefits,

3

further providing for blind veteran's pension and for

paralyzed veteran's pension.

The General Assembly of the Commonwealth of Pennsylvania

6

hereby enacts as follows:

7

Section 1.  Section 7702 of Title 51 of the Pennsylvania

§ 7701.  Blind veteran's pension.

(b)  Amount and eligibility.--In addition to any other

14

assistance provided by the Commonwealth and in addition to any

15

compensation provided by the Federal Government, every blind

16

veteran shall be paid a pension of [$150] $200 per month.

Applications for such pensions shall be made to and in the form

2

prescribed by the department. The Adjutant General shall have

3

the power, and it shall be his duty to determine the eligibility

4

of every applicant for a pension, and his decision in the matter

5

shall be final.

§ 7702.  Paralyzed veteran's pension.

7

(a)  Amount and eligibility.--In addition to any other

8

assistance provided by the Commonwealth and in addition to any

9

compensation provided by the Federal Government, every paralyzed

10

veteran shall be paid a pension of [$150] $200 per month.

11

Applications for the pensions shall be made to and in the form

12

prescribed by the department. The Adjutant General shall

13

determine the eligibility of every applicant for a pension, and

14

his decision in the matter shall be final.

(b)  Regulations.--The Adjutant General shall promulgate such

16

regulations as may be necessary to implement this program.

(c)  Definition.--As used in this section the term "paralyzed

18

veteran" means any person who served in the military or naval

19

forces of the United States, or any woman's organization

20

officially connected therewith, and who gave this Commonwealth

21

as his or her place of residence at the time of entering the

22

military or naval forces of the United States and who, while

23

performing duties connected with such service, suffered an

24

injury or incurred a disease which resulted in the veteran's

being considered paralyzed and rated with a 100% service-

26

connected disability, as determined and certified by the United

27

States Department of Veterans Affairs, due to the loss or total 

28

loss of use of two or more extremities. The term does not

29

include any person separated from the military or naval forces

30

of the United States, or any woman's organization officially

connected therewith, under other than honorable conditions.

(1)  prior to the effective date of this paragraph, the

4

loss or loss of use of two or more extremities; or

5

(2)  on or after the effective date of this paragraph,

6

the veteran being considered paralyzed and rated with a 100%

7

service-connected disability, as determined and certified by

8

the United States Department of Veterans Affairs, due to the

9

loss or total loss of use of two or more extremities.

The term does not include any person separated from the military

11

or naval forces of the United States, or any woman's

12

organization officially connected therewith, under other than

13

honorable conditions.

Section 2.  This act shall take effect immediately.
