                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, providing for the
     3     confidentiality of certain communications with sexual assault
     4     counselors.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Title 42, act of November 25, 1970 (P.L.707,
     8  No.230), known as the Pennsylvania Consolidated Statutes, is
     9  amended by adding a section to read:
    10  § 5945.1.  Confidential communications to sexual assault
    11             counselors.
    12     No sexual assault counselor who is engaged in any office or
    13  institution commonly known as a rape crisis center, whose
    14  primary function is the rendering of advice or assistance to the
    15  victim of a sexual assault who sought counseling concerning a
    16  mental, physical or emotional condition caused by a sexual
    17  assault shall, without written consent of the victim, disclose
    18  in any civil or criminal proceeding any information whether


     1  written or spoken, acquired in the course of his professional
     2  services in behalf of such victim.
     3     Section 2.  This act shall take effect in 60 days.
