AN ACT

Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An

2

act relating to the public school system, including certain

3

provisions applicable as well to private and parochial

4

schools; amending, revising, consolidating and changing the

5

laws relating thereto," in education empowerment, further

6

providing for mandate waiver program.

The General Assembly of the Commonwealth of Pennsylvania

8

hereby enacts as follows:

Section 1.  Section 1714-B of the act of March 10, 1949

10

(P.L.30, No.14), known as the Public School Code of 1949, is

11

amended by adding a subsection to read:

Section 1714-B.  Mandate Waiver Program.--* * *

13

(o)  (1)  A school district receiving a mandate waiver of the

14

provisions of section 751 regarding separation of contracts

15

shall be granted such waiver under the condition that the school

16

district shall solicit bids for the school construction project

17

both as a single-prime contractor construction project and a

18

multiple-prime contractor construction project that complies

19

with the provisions of section 751. The school district shall

20

submit all single-prime contract bids and all multiple-prime

contract bids to the department for use in studying the

2

potential cost or savings generated by waivers of the provisions

3

of section 751 regarding separation of contracts.

(2)  The department shall collect and analyze the bids

5

submitted pursuant to paragraph (1) and report to the General

6

Assembly its findings regarding the potential costs or savings

7

of mandate waivers of the provisions of section 751 within three

8

(3) years of the effective date of this subsection.

9

Section 2.  This act shall take effect in 60 days.
