AN ACT

 

1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, further providing for additional parking
3regulations.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1.  Section 3354(d)(3)(i) and (e) of Title 75 of the
7Pennsylvania Consolidated Statutes are amended to read:

8§ 3354.  Additional parking regulations.

10(d)  Person with a disability and disabled veterans.--

12(3)  (i)  Except for persons parking vehicles lawfully
13bearing a person with a disability, disabled veteran or
14severely disabled veteran registration plate or
15displaying a person with a disability or severely
16disabled veteran parking placard when such vehicles are

1being operated by or for the transportation of a person
2with a disability, a disabled veteran or a severely
3disabled veteran, no person shall park a vehicle on
4public or private property reserved for a person with a
5disability, disabled veteran or severely disabled veteran
6which property has been so posted in accordance with
7departmental regulations. Regulations shall require that
8parking spaces designated with an international symbol
9for access for persons with disabilities on a sign are
10posted with a sign stating the penalty amount indicated
11in subsection (f) and that vehicles in violation of the
12subsection may be towed and require that signs be
13replaced when they become either obsolete or missing with
14all costs to replace the necessary signs to be borne by
15the persons responsible for signing the particular
16location. The absence of a sign stating the penalty
17amount at parking spaces designated with an international
18symbol for access for persons with disabilities shall not
19preclude the enforcement of this subsection. A vehicle
20which is unlawfully parked in a designated person with a
21disability parking area may be removed from that area by
22towing and may be reclaimed by the vehicle owner upon
23payment of the towing costs. A vehicle may only be towed
24under this paragraph if the parking space is posted with
25a sign indicating that vehicles in violation of this
26section may be towed.

28(e)  Unauthorized use.--

29(1)  An operator of a vehicle bearing a person with a
30disability, disabled veteran or severely disabled veteran

1plate [or displaying a person with a disability or severely
2disabled veteran parking placard] shall not make use of the
3parking privileges accorded to a person with a disability, 
4disabled veterans and severely disabled veterans under
5subsection (d)(3) unless the operator is a person with a
6disability, a disabled veteran or a severely disabled veteran
7or unless the vehicle is being operated for the
8transportation of a person with a disability, disabled 
9veteran or severely disabled veteran.

10(2)  An operator of a vehicle displaying a person with a
11disability or severely disabled veteran parking placard shall
12not make use of the parking privileges accorded to a person
13with a disability and a severely disabled veteran under
14subsection (d)(3) unless the operator is a person with a
15disability or a severely disabled veteran or unless the
16vehicle is being operated for the transportation of a person
17with a disability or a severely disabled veteran.

19Section 2.  This act shall take effect in 60 days.
