A CONCURRENT RESOLUTION
1 Disapproving the Department of Welfare regulation on medical
2 assistance Statewide ceilings for skilled nursing and
3 intermediate care facilities.
4 WHEREAS, The Department of Public Welfare has proposed a
5 regulation relating to medical assistance Statewide ceilings for
6 skilled nursing and intermediate care facilities under the
7 authority of section 443.1(2) and (3) of the act of June 13,
8 1967 (P.L.31, No.21), known as the Public Welfare Code; and
9 WHEREAS, The Senate Committee on Public Health and Welfare
10 and the House Committee on Public Health and Welfare recommended
11 disapproval of the proposed regulation to the Independent
12 Regulatory Review Commission under section 5(c)of the act of
13 June 25, 1982 (P.L.633, No.181), known as the Regulatory Review
14 Act; and
15 WHEREAS, The committee received notice under section 6(c) of
16 the act that the commission approved the proposed regulation;
17 and
18 WHEREAS, The committee has determined that the proposed
1 regulation should be disapproved by the General Assembly and
2 notified the Department of Public Welfare of this determination;
3 and
4 WHEREAS, The committee reports this resolution under section
5 7(c) of the act for action by the General Assembly within 30
6 calendar days or ten legislative days, whichever is longer, from
7 the date of reporting this resolution; therefore be it
8 RESOLVED (the Senate concurring), That the General Assembly
9 disapprove the proposed regulation of the Department of Public
10 Welfare on medical assistance Statewide ceilings for skilled
11 nursing and intermediate care facilities; and be it further
12 RESOLVED, That notice of the final disposition of this
13 resolution be sent to the Department of Public Welfare and
14 published in the Pennsylvania Bulletin.
