AS REPORTED FROM COMMITTEE ON STATE GOVERNMENT, HOUSE OF
REPRESENTATIVES, AS AMENDED, MARCH 12, 1991
AN ACT
1 Authorizing the incurring of indebtedness, with the approval of
2 the electorate, of $200,000,000 for the creation of a State
3 Public Land Trust to be used for the acquisition of public
4 lands, easements and rights-of-way by the Commonwealth, local
5 governments and nonprofit conservancy organizations.
6 The General Assembly of the Commonwealth of Pennsylvania
7 hereby enacts as follows:
8 Section 1. Question.
9 The question of incurring indebtedness of $200,000,000 for
10 the purpose of creating a State Public Land Trust to be used for
11 the acquisition of public lands, easements and rights-of-way for
12 purposes of enhancing the natural, recreational, scenic and <--
13 historic value of land within this Commonwealth, and to maintain
14 existing State parks, shall be submitted to the electors at the
15 next primary, municipal or general election following the
1 effective date of this act.
2 Section 2. Certification.
3 The Secretary of the Commonwealth shall certify the form of
4 the question under section 3 to the county boards of elections.
5 Section 3. Form of question.
6 The question under section 1 shall be in substantially the
7 following form:
8 Do you favor the incurring of indebtedness by the
9 Commonwealth of $200,000,000 for the creation of a State
10 Public Land Trust to be used for the acquisition of
11 public lands, easements and rights-of-way to enhance FOR <--
12 ENHANCING LAND AND WATER QUALITY AND FOR PRESERVING the
13 natural, recreational, scenic and historic value of lands <--
14 within this Commonwealth and for the maintenance of
15 existing State parks?
16 Section 4. Election.
17 The election shall be conducted in accordance with the act of
18 June 3, 1937 (P.L.1333, No.320), known as the Pennsylvania
19 Election Code., except that the time limits for advertisement of <--
20 notice of the elections may be waived as to the question.
21 Section 5. Proceeds.
22 Proceeds of borrowing shall be used by the Commonwealth,
23 local governments and nonprofit conservancy organizations to
24 acquire lands, easements and rights-of-way to enhance the
25 natural, recreational, scenic and historic values of land within <--
26 this Commonwealth and to maintain existing State parks.
27 Section 6. Effective date.
28 This act shall take effect immediately.
