        AS AMENDED ON THIRD CONSIDERATION, IN SENATE, FEBRUARY 11, 1986

                                     AN ACT

     1  Amending Title 51 (Military Affairs) of the Pennsylvania
     2     Consolidated Statutes, providing a pension for certain
     3     paralyzed veterans.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  The heading of Chapter 77 of Title 51 of the
     7  Pennsylvania Consolidated Statutes is amended to read:
     8                             CHAPTER 77
     9                     [BLIND VETERAN'S PENSION]
    10                  VETERANS' PENSIONS AND BENEFITS
    11                               * * *
    12     Section 2.  Title 51 is amended by adding a section to read:
    13  § 7702.  Paralyzed veteran's pension.
    14     (a)  Amount and eligibility.--In addition to any other
    15  assistance provided by the Commonwealth and in addition to any
    16  compensation provided by the Federal Government, every paralyzed
    17  veteran shall be paid a pension of $100 per month. Applications


     1  for the pensions shall be made to and in the form prescribed by
     2  the department. The Adjutant General shall determine the
     3  eligibility of every applicant for a pension and his decision in
     4  the matter shall be final.
     5     (B)  REGULATIONS.--THE ADJUTANT GENERAL SHALL PROMULGATE SUCH  <--
     6  REGULATIONS AS MAY BE NECESSARY TO IMPLEMENT THIS PROGRAM.
     7     (b) (C)  Definition.--As used in this section the term         <--
     8  "paralyzed veteran" means any person who served in the military
     9  or naval forces of the United States, or any woman's
    10  organization officially connected therewith, during an
    11  established war or armed conflict service dates, and who gave
    12  this Commonwealth as his place of residence at the time of
    13  entering the military or naval forces of the United States and
    14  is currently a resident of this Commonwealth and who, while
    15  performing duties connected with that service, suffered an
    16  injury or incurred a disease which resulted in the loss or loss
    17  of use of two or more extremities. The term does not include any
    18  person separated from the military or naval forces of the United
    19  States, or any woman's organization officially connected
    20  therewith, under other than honorable conditions. THE TERM SHALL  <--
    21  INCLUDE PERSONS WHO HAVE BEEN PARALYZED AS A RESULT OF PEACETIME
    22  COMBAT-RELATED ACTIONS AS DEFINED BY THE DEPARTMENT OF MILITARY
    23  AFFAIRS. THE DEPARTMENT SHALL, BY REGULATION, ESTABLISH CRITERIA
    24  TO DETERMINE ELIGIBILITY BASED ON PARTICIPATION IN A PEACETIME
    25  COMBAT-RELATED SITUATION, WHICH SHALL INCLUDE, BUT NOT BE
    26  LIMITED TO, HOSTILE FIRE OR TERRORIST ATTACK.
    27     Section 2.  This act shall take effect July 1, 1985 or         <--
    28  immediately, whichever is later.
    29     SECTION 2 3.  (A)  51 PA.C.S. § 7702(B) (RELATING TO           <--
    30  PARALYZED VETERAN'S PENSION) SHALL TAKE EFFECT IMMEDIATELY.

     1     (B)  THE REMAINDER OF THIS ACT SHALL TAKE EFFECT JULY 1,
     2  1986.
