                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for additional parking
     3     regulations relating to handicapped persons and severely
     4     disabled veterans.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 3354(d) of Title 75 of the Pennsylvania
     8  Consolidated Statutes is amended to read:
     9  § 3354.  Additional parking regulations.
    10     * * *
    11     (d)  Handicapped persons and severely disabled veterans.--
    12         (1)  When a motor vehicle bearing a handicapped or
    13     severely disabled veteran plate or displaying a handicapped
    14     or severely disabled veteran parking placard as prescribed in
    15     this title is being operated by or for the transportation of
    16     the handicapped person or severely disabled veteran, the
    17     driver shall be relieved of any liability for parking for a


     1     period of 60 minutes in excess of the legal parking period
     2     permitted by local authorities except where local ordinances
     3     or police regulations provide for the accommodation of heavy
     4     traffic during morning, afternoon or evening hours.
     5         (2)  At the request of any handicapped person or severely
     6     disabled veteran, local authorities may erect on the highway
     7     as close as possible to their place of residence [a sign or
     8     signs] an official sign indicating that that place is
     9     reserved for the handicapped person or severely disabled
    10     veteran[, that no parking is allowed there by others, and
    11     that any unauthorized person parking there shall be subject
    12     to a fine].
    13         (3)  (i)  Except for persons parking vehicles lawfully
    14         bearing a handicapped or severely disabled veteran
    15         registration plate or displaying a handicapped or
    16         severely disabled veteran parking placard when such
    17         vehicles are being operated by or for the transportation
    18         of a handicapped person or a severely disabled veteran,
    19         no person shall park a vehicle on public or private
    20         property in a parking space reserved for a handicapped
    21         person or severely disabled veteran [which property has
    22         been so posted in accordance with departmental
    23         regulations which shall require a sign stating the
    24         penalty amount indicated in subsection (f), a sign
    25         indicating that vehicles in violation of the subsection
    26         may be towed and require that signs be replaced when they
    27         become either obsolete or missing with all costs to
    28         replace the necessary signs to be borne by the persons
    29         responsible for signing the particular location]. Any
    30         vehicle which is unlawfully parked in a designated

     1         handicapped parking area may be removed from that area by
     2         towing and may be reclaimed by the vehicle owner upon
     3         payment of the towing costs.
     4             (ii)  Local authorities shall have the power and may,
     5         by ordinance or resolution, authorize handicapped persons
     6         and severely disabled veterans to issue statements to
     7         violators or violating vehicles for violation of
     8         subparagraph (i). The form of the statement shall be as
     9         prescribed by the local authorities.

    11     Section 2.  This act shall take effect in 60 days.
