                                     AN ACT

     1  Amending the act of June 3, 1937 (P.L.1225, No.316), entitled
     2     "An act concerning game and other wild birds and wild
     3     animals; and amending, revising, consolidating, and changing
     4     the law relating thereto," reducing license fees for certain
     5     aliens.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 303, act of June 3, 1937 (P.L.1225,
     9  No.316), known as "The Game Law," amended December 10, 1974
    10  (No.267), is amended to read:
    11     Section 303.  Nonresident Hunting and Alien License Fees.--
    12  Every citizen of the United States who is a nonresident of this
    13  Commonwealth, upon application made, in writing, to any agent
    14  authorized to issue such licenses, or to the commission, unless
    15  any such person has been disqualified for a license in the
    16  manner hereinafter specified, and upon payment to said agent or
    17  commission of forty dollars and thirty-five cents ($40.35) shall
    18  be entitled to the license herein designated as a Nonresident
    19  Hunter's License and a tag with the number of the license


     1  thereon, which shall entitle the holder to hunt for all wild
     2  birds and wild animals which may legally be hunted in this
     3  Commonwealth, until the close of the license year. Other
     4  licenses valid for use by nonresidents and aliens shall be as
     5  follows:
     6     Nonresident trapper's license which shall be issued only upon
     7  application to the Commission in Harrisburg and which shall be
     8  effective for the same period as hunters' licenses shall entitle
     9  the holder to take through the use of traps or deadfalls only
    10  wild birds and wild animals which may legally be trapped in this
    11  Commonwealth, except beavers, forty dollars ($40). Nothing in
    12  this clause shall be construed to prohibit the holder of a
    13  nonresident trapper's license from using a sidearm or a rifle
    14  not larger than a .22 rimfire caliber to kill legally caught
    15  birds and animals.
    16     Every unnaturalized person, upon written application made to
    17  any county treasurer of Pennsylvania, any field division office
    18  of the Pennsylvania Game Commission, or any agent authorized by
    19  the Commission to issue non-resident hunting licenses setting
    20  forth satisfactory evidence of his mental and physical fitness
    21  to carry and use firearms and presentation of proof of legal
    22  entry into the United States, unless any such person has been
    23  disqualified for a license in the manner hereinafter specified,
    24  and upon the payment to any county treasurer in Pennsylvania,
    25  any field division office of the Pennsylvania Game Commission,
    26  or any agent authorized by the Commission to issue non-resident
    27  hunting licenses the fee of forty dollars and thirty-five cents
    28  ($40.35), or if he has filed a Pennsylvania personal income tax
    29  return the preceding year, the fee of eight dollars and twenty-
    30  five cents ($8.25), shall be entitled to an alien hunter's

     1  license, and the proper tag issued therewith, but the one
     2  issuing said license shall indicate on the face of the license
     3  that the holder is an alien.
