AMENDMENTS TO HOUSE BILL NO. 657

Amend Bill, page 1, line 3, by inserting after "AGREEMENTS;"
providing for records notification service;
Amend Bill, page 2, by inserting between lines 2 and 3
"Recorder." As follows:
(1) A county recorder of deeds or a county official or
department responsible for the recording of documents in a
county without a recorder of deeds.
(2) The term includes the Philadelphia Department of
Records and the Allegheny County Division of Real Estate.
"Records notification service." The records notification
service established under section 8(a).
Amend Bill, page 6, by inserting between lines 22 and 23
Section 8. Records notification service.
(a) Establishment, maintenance and purpose.--Each recorder
shall establish and maintain a free records notification service
to alert a landowner of any recording tending to affect a right,
title or interest in the real property of the landowner.
(b) Duties.--Each recorder that establishes and maintains a
records notification service shall:
(1) Ensure that the records notification service is
capable of notifying a landowner by text or email within 24
hours of any recording tending to affect a right, title or
interest in the real property of the landowner.
(2) Allow a homeowner to register for the recording
notification service.
(c) Construction.--Nothing in this section shall be
construed to require a recorder to provide or allow access to a
record or information that is confidential or exempt under law.
(d) Immunity.--A recorder shall not be subject to a cause of
action or civil liability regarding the creation, maintenance or
operation of a records notification service.
