Amend Bill, page 1, lines 1 and 2, by striking out "upon
death"
Amend Bill, page 1, line 8, by striking out "Upon Death"
Amend Bill, page 1, by inserting between lines 12 and 13
"Attendance boundary." As defined in section 2002-B of the
act of March 10, 1949 (P.L.30, No.14), known as the Public
School Code of 1949.
"Low-achieving school." As defined in section 2002-B of the
Public School Code of 1949.
Amend Bill, page 2, lines 3 through 7, by striking out all of
said lines and inserting
(a) General rule.--
(1) A provider may not impose a fee for early
termination of a service contract if a party to the contract
dies before complete performance of the contract and the
executor or administrator of the decedent's estate provides
notice under subsection (c).
(2) A provider may not impose a fee for early
termination of a service contract if a party to the contract
breaches the contract as a result of permanently moving out
of the attendance boundary of a low-achieving school and into
the attendance boundary of a school that is not a low-
achieving school. This paragraph shall not apply upon the
enactment of legislation to provide for a program to provide
scholarships to eligible students in low-achieving schools to
pay tuition, school-related fees and special education
services fees for attendance at a participating nonpublic
school. The Chief Clerk of the Senate and the Chief Clerk
of the House of Representatives shall jointly submit a notice
of the enactment of legislation specified under this
paragraph to the Legislative Reference Bureau for publication
in the next available issue of the Pennsylvania Bulletin.
