AMENDMENTS TO HOUSE BILL NO. 773

Amend Bill, page 2, lines 12 through 17, by striking out all
of said lines and inserting
(c.2) Consecutive sentence.--The following shall apply:
(1) A sentence imposed upon an individual under this
section who has two or more prior offenses shall be served
consecutively to any other sentence the individual is serving
and to any other sentence being then imposed by the court,
except for those with which the offense must merge as a
matter of law.
(2) Notwithstanding paragraph (1), the court may, in its
discretion, impose a nonconsecutive sentence under this
subsection if it deems it appropriate and states on the
record its reasons for imposing a nonconsecutive sentence.
