Amend Bill, page 13, by inserting between lines 22 and 23
Section 1845. Failure to File Expense Account.--(a) Any
candidate or treasurer of a political committee or person acting
as such treasurer who shall fail to file an account of primary
or election expenses, as required by this act, shall be guilty
of committing an offense that shall be graded as follows:
(1) For a first offense, a misdemeanor, and, upon conviction
thereof, shall be sentenced to pay a fine not exceeding five
thousand dollars ($5,000), or to undergo an imprisonment of not
less than one (1) month nor more than two (2) years, or both, in
the discretion of the court.
(2) For a second or subsequent offense, a felony, and, upon
conviction thereof, shall be sentenced to pay a fine not
exceeding ten thousand dollars ($10,000), or to undergo an
imprisonment of not less than one (1) year nor more than two (2)
years, or both, in the discretion of the court.
(b) The Department of State shall be authorized to refer a
second or subsequent offense under this section to the Office of
Attorney General or a district attorney pursuant to the act of
October 15, 1980 (P.L.950, No.164), known as the Commonwealth
Attorneys Act, for prosecution.
