Amend Bill, page 3, line 20, by inserting after "longer."
Each quarter, an employer shall certify to the department
that the employer has utilized the E-verify program in
compliance with applicable Federal rules and regulations for all
employees hired during the last completed calendar quarter. The
statement shall be on a form prescribed by the department and
contain a statement that the information provided is in
compliance with 18 Pa.C.S. § 4904 (relating to unsworn
falsification to authorities).
Amend Bill, page 8, by inserting between lines 25 and 26
(e) Civil penalties.--
(1) In addition to other penalties or remedies, a
violation of any requirement under section 3(b) shall be
subject to a civil penalty of not more than $2,500 per
violation. Each day for each employee affected shall
constitute a separate violation.
(2) Civil penalties collected under this subsection
shall be deposited into the Access to Justice Account under
42 Pa.C.S. § 4904 (relating to establishment of Access to
Justice Account) for legal assistance for individuals
negatively affected by employment discrimination or the use
of the E-verify program.
