11Section 111.2. Electronic Public Safety and Criminal Justice
12Information.--(a) Subject to subsection (b), the Department of
13Education shall obtain and monitor public safety and criminal
14justice information, including, but not limited to, arrest and
15disposition information, for all educators from any Statewide
16electronic database to the extent such public safety and
17criminal justice information is available to the Department of
18Education and shall use such information for certification and
19discipline purposes.

20(b) For purposes of this section, "educator" shall mean all
21of the following:

22(1) Any person who holds a Commonwealth of Pennsylvania
23certificate, commission, letter of eligibility or permit issued
24under this act or under the act of January 28, 1988 (P.L.24,
25No.11), known as the "Private Academic Schools Act," or who has
26applied for a certificate, commission, letter of eligibility or
27permit.

28(2) Any person who is a charter or cyber charter school
29staff member or who is a contracted educational provider or
30contracted educational provider staff member as those terms are
31defined in the act of December 12, 1973 (P.L.397, No.141), known
32as the "Educator Discipline Act."

33(3) Any person over whom the Professional Standards and 
34Practices Commission has disciplinary authority pursuant to the
 

1"Educator Discipline Act."
