AMENDMENTS TO HOUSE BILL NO. 1714

1Amend Bill, page 7, by inserting between lines 10 and 11

2(g)  A landlord may not dispose of or otherwise exercise
3control over personal property remaining on the premises under 
4the provisions of this section if any of the following apply:

5(1)  The landlord fails to hold a rental license, certificate
6of occupancy, certificate of suitability to rent or other
7licensure requirements that the landlord must meet prior to
8leasing a residential property as required by the applicable
9provisions of all municipal, county and Commonwealth codes,
10regulations, ordinances, and statutes in the jurisdiction in
11which the rental property is located.

12(2)  The tenant has taken any of the following actions:

13(i)  Filed a complaint with a code enforcement office, health
14department or any governmental office regarding the condition of
15the property.

16(ii)  Filed a civil action, or notified the landlord of the
17tenant's intent to file a civil action, against the landlord
18regarding the condition of the property.

19(iii)  Notified the landlord that the tenant is exercising
20his rights under the implied warranty of habitability or under
21the act of January 24, 1966 (1965 P.L.1534, No.536), referred to
22as the City Rent Withholding Act.

23(3)  Code violations have been cited and still exist on the
24property. For purposes of this paragraph, "code" may include a
25building, housing, property maintenance, fire, health or other
26public safety ordinance, related to the use or maintenance of
27real property, enacted by a municipality.
