19offense under this section is a misdemeanor of the second
20degree.

22(3) If the intent of the actor is to impersonate a
23doctor of medicine and, in so doing, the actor provides 
24medical advice or treatment to another person as a patient, 
25regardless of whether or not the other person suffers harm 
26from the medical advice or treatment, an offense under this 
27section is a misdemeanor of the first degree.
