Section 1.  Section 502 of the act of December 19, 1988

10

(P.L.1262, No.156), known as the Local Option Small Games of

11

Chance Act, added February 2, 2012 (P.L.7, No.2), is amended to

12

read:

13

Section 502.  Distribution of proceeds.

14

(a)  Distribution.--The proceeds from games of chance

15

received by a club licensee shall be distributed as follows:

16

(1)  No less than 70% of the proceeds shall be paid to

17

organizations for public interest purposes in the calendar

18

year in which the proceeds were obtained. This paragraph

19

includes charity events, scholarship programs and other

20

philanthropic events:

21

(i)  held by the club on its licensed premises; and

22

(ii)  available to club members, club member families

23

or the general public.

24

(2)  No more than 30% of the proceeds obtained in a

25

calendar year may be retained by a club licensee and used for

26

the following operational expenses relating to the club

27

licensee:

28

(i)  Real property taxes.

29

(ii)  Utility and fuel costs.

30

(iii)  Heating and air conditioning equipment or

31

repair costs.

32

(iv)  Water and sewer costs.

33

(v)  Property or liability insurance costs.

(vi)  Mortgage payments.

(vii)  Interior and exterior repair costs, including

2

repair to parking lots.

3

(viii)  New facility construction costs.

4

(ix)  Entertainment equipment, including television,

5

video and electronic games.

6

(x)  Other expenses adopted in regulation by the

7

department.

(a.1)  Amounts retained.--Amounts retained by a club licensee

9

under subsection (a)(2) shall be expended within the same

10

calendar year unless the club licensee notifies the department

11

that funds are being retained for a substantial purchase or

12

project. Notification shall include a description of the

13

purchase or project, the cost and the anticipated date of the

14

purchase or project.

(b)  Prohibition.--

16

(1)  Proceeds shall not be used for wages, alcohol or

17

food purchases or for the payment of any fine levied against

18

the club licensee.

19

(2)  An officer or employee of a club licensee who

20

operates the game of chance shall not participate in the

21

game. This paragraph shall not apply to a raffle.

22

Section 2.  This act shall take effect in 60 days.
