Section 3.  Title 53 is amended by adding a section to read:

§ 5710.  Use of natural gas powered vehicles.

11

(a)  General rule.--On an annual basis, the authority shall

12

use 25% of the proceeds of the annual auction of medallions

13

authorized under section 5711 (relating to power of authority to

14

issue certificates of public convenience) for a grant or low

15

interest loan program to increase the number of natural gas

16

refueling stations for natural gas powered wheelchair-accessible

17

taxicabs in cities of the first class.

18

(b)  Intergovernmental cooperation.--The authority shall

19

coordinate with the Pennsylvania Public Utility Commission, the

20

Department of Environmental Protection and each city of the

21

first class in the development of the program priorities, the

22

application process and the process and manner by which grants

23

and loans shall be made in order to increase the number of

24

natural gas refueling stations for natural gas powered

25

wheelchair-accessible taxicabs in cities of the first class.

26

(c)  Natural gas refueling stations.--Any person or entity

27

receiving a grant or loan under this section shall agree to make

28

natural gas refueling stations available to the general public.

29

(d)  Public participation.--The authority shall publish the

30

proposed details of the grant or low interest loan program in

31

the Pennsylvania Bulletin and shall take public comments.

Section 5.  Title 53 is amended by adding a section to read:

22

§ 5721.1.  Injured taxicab driver relief fund.

23

(a)  Establishment and deposit.--At least 25% of the total

24

proceeds of the annual auction of taxicab medallions issued

25

after the effective date of this section shall be deposited by

26

the authority into a dedicated account, which shall be known as

27

the injured taxicab driver relief fund, within 30 days of the

28

auction.

29

(b)  Administration.--

30

(1)  The fund shall be administered by a nonprofit

31

corporation with at least ten years of experience in

32

providing services to the disabled within the geographical

33

area under the jurisdiction of the authority.

34

(2)  The authority shall choose an eligible nonprofit

35

corporation to review and make determinations on applications

36

for assistance from the fund.

37

(3)  A standard application for assistance form shall be

developed by the nonprofit corporation and used by it in

2

soliciting requests for relief funds under this section.

(c)  Advisory board.--An advisory board comprised of members

4

of organizations that represent the interests of taxicab drivers

5

and individual taxicab owners or drivers shall be established by

6

the authority to assist the nonprofit organization in

7

administering the fund established under this section. The

8

advisory board shall hold regular meetings. The executive

9

director of the authority or a designee shall be a member of the

10

advisory board.

11

(d)  Review of applications.--  In reviewing requests for

12

assistance from the fund, the nonprofit organization shall take

13

into consideration all other sources of income or assistance

14

available to the applicant and the applicant's household

15

members. Priority consideration for assistance shall be given

16

based on the severity of injury or disability of the applicant.

17

(e)  Fees.--The authority may establish and collect a nominal

18

fee from each taxicab driver who applies for assistance under

19

this section as a condition of eligibility for assistance.

20

(f)  Limitation of administrative costs.--No more than 10% of

21

the fund may be expended by the nonprofit organization to

22

administer the fund.

23

(g)  Financial report.--

24

(1)  The nonprofit corporation selected to administer the

25

fund shall provide to the authority a financial report

26

detailing all monies received and all expenditures of the

27

fund for the year being reported.

28

(2)  The nonprofit corporation shall submit to the

29

authority on an annual basis the results of an independent

30

audit of the fund as conducted by an outside certified public

31

accountant.

32

Section 6.  Sections 5725(a) and 5745(a) of Title 53 are

33

amended to read:
