3 | (a.1) Road damage.-- |
4 | (1) Upon filing an application for a well permit, and |
5 | before continuing to operate an oil or gas well, the owner or |
6 | operator of the well shall file a bond covering road damage |
7 | on a form to be prescribed and furnished by the department. |
8 | The bond shall be filed with the department for State |
9 | highways to be traveled incident to oil and gas operations. |
10 | The bond shall be filed with a municipality for local |
11 | highways to be traveled incident to oil and gas operations. |
12 | The bond shall be payable to the Commonwealth or the |
13 | municipality, as applicable, and conditioned upon the payment |
14 | of all sums due for restoration and repair of roads damaged |
15 | by oil and gas operations. The bond required shall be in the |
16 | amount of $250,000 per road mile. |
17 | (2) Liability under the bond shall continue during |
18 | drilling, hydraulic fracturing and completion of a well. Each |
19 | bond shall be executed by the owner or operator and a |
20 | corporate surety licensed to do business in this Commonwealth |
21 | and approved by the secretary. |
