2 | through 5 (A06347), by striking out all of said lines on said |
3 | pages and inserting |
4 | (1) except as set forth in paragraph (2): |
5 | (i) the pollution existed prior to the drilling or |
6 | alteration activity as determined by a predrilling or |
7 | prealteration survey; |
8 | (ii) the landowner or water purveyor refused to |
9 | allow the operator access to conduct a predrilling or |
10 | prealteration survey; |
11 | (iii) the water supply is not within 1,000 feet of |
12 | the well; |
13 | (iv) the pollution occurred more than six months |
14 | after completion of drilling or alteration activities; |
15 | and |
16 | (v) the pollution occurred as the result of a cause |
17 | other than the drilling or alteration activity; or |
18 | (2) in the case of an unconventional well: |
19 | (i) the pollution existed prior to the drilling or |
20 | alteration activity as determined by a predrilling or |
21 | prealteration survey; |
22 | (ii) the landowner or water purveyor refused to |
23 | allow the operator access to conduct a predrilling or |
24 | prealteration survey; |
25 | (iii) the water supply is not within 2,500 feet of |
26 | the well; and |
27 | (iv) the pollution occurred more than 12 months |
28 | after completion of drilling or alteration activities. |
