Amend Bill, page 4, lines 28 through 30; page 5, lines 1

through 9, by striking out "to write, send or read any text-

3

based communication, " in line 28, all of lines 29 and 30 on

4

page 4 and all of lines 1 through 9 on page 5 and inserting

5

 for a purpose other than:

6

(1)  voice communication through the use of an

7

interactive wireless communication device while in hands-free

8

mode;

9

(2)  reading, selecting or entering a telephone number or

10

name into an interactive wireless communication device for

11

the purpose of voice communication; or

12

(3)  utilizing a global positioning or navigation system.

13

(b)  Exceptions.--This section shall not apply to:

14

(1)  A driver using an interactive wireless communication

15

device to contact a 911 system or wireless E-911 service, as

16

defined in the act of July 9, 1990 (P.L.340, No.78), known as

17

the Public Safety Emergency Telephone Act.

18

(2)  A driver using an interactive wireless communication

19

device when the vehicle is stopped due to a traffic

20

obstruction and the motor vehicle transmission is in neutral

21

or park.

22

(3)  Operators of emergency vehicles who use an

23

interactive wireless communication device for voice

24

communication for the purpose of responding to an emergency

25

while engaged in the performance of their official duties.

26

(4)  Volunteer emergency responders who use an

27

interactive wireless communication device for voice

28

communication for the purpose of responding to an emergency

29

while engaged in the performance of their official duties.

Amend Bill, page 6, by inserting between lines 1 and 2

31

"Hands-free mode."  The use of an interactive wireless

32

communication device that allows the user to engage in

33

communication without the use of either hand by means of an

34

internal feature or function or an attachment or device.

"Volunteer emergency responder."  Any of the following:

(1)  A member of a volunteer ambulance service as defined

5

in section 102 of the act of July 31, 2003 (P.L.73, No.17),

known as the Volunteer Fire Company and Volunteer Ambulance

7

Service Grant Act.

(2)  A member of a volunteer fire company as defined in

9

section 102 of the Volunteer Fire Company and Volunteer

10

Ambulance Service Grant Act.

(3)  A member of a volunteer rescue company as defined in

12

section 102 of the Volunteer Fire Company and Volunteer

13
