1 | Amend Bill, page 13, line 7, by inserting after "share." |
2 | Any such joint plan must meet the same requirements |
3 | applicable to the plan of an individual manufacturer. |
4 | Amend Bill, page 13, lines 10 through 28, by striking out all |
5 | of said lines and inserting |
6 | (1) Collection, handling and recycling or reuse of |
7 | electronic waste pursuant to the laws of this Commonwealth in |
8 | a manner convenient to consumers. The following acceptance |
9 | methods shall be considered reasonably convenient: |
10 | (i) Mail or ship back return programs. |
11 | (ii) Collection or acceptance events conducted by |
12 | the manufacturer or the manufacturer's agent or designee, |
13 | including events conducted through local governments or |
14 | private parties. |
15 | (iii) Fixed acceptance locations, such as dedicated |
16 | acceptance sites operated by the manufacturer or its |
17 | agent or designee. |
18 | (iv) Agreements with municipalities, retail stores, |
19 | sales outlets and not-for-profit organizations which have |
20 | agreed to provide facilities for the collection of |
21 | electronic waste. |
22 | (v) Community collection events. |
23 | (vi) Any combination of these or other acceptance |
24 | methods which effectively provide for the acceptance of |
25 | electronic waste for recycling or reuse through means |
26 | that are available and reasonably convenient to consumers |
27 | in this Commonwealth. |
28 | At a minimum, the manufacturer shall ensure that all |
29 | municipalities which have a population of at least 10,000 |
30 | have at least one method of acceptance that is available |
31 | within the municipality. The department may establish |
32 | additional requirements to ensure convenient collection from |
33 | consumers. |
34 | (2) Information on how consumers can destroy all data on |
35 | any electronic waste, either through physical destruction of |
36 | the hard drive or through data wiping. |

1 | (3) A public education program to inform consumers about |
2 | the manufacturer's electronic waste acceptance program, |
3 | including at a minimum: |
4 | (i) An Internet website, a toll-free telephone |
5 | number and written information included in the product |
6 | manual for, or at the time of sale of, covered electronic |
7 | devices that provide sufficient information to allow a |
8 | consumer of covered electronic devices to learn how to |
9 | return the covered electronic devices for recycling or |
10 | reuse and, in the case of manufacturers of computers, |
11 | hard drives and other covered electronic devices that |
12 | have internal memory on which personal or other |
13 | confidential data can be stored, the Internet website |
14 | shall provide instructions for how consumers can destroy |
15 | the data before surrendering the devices for recycling or |
16 | reuse. |
17 | (ii) Advertisements and press releases, if any. |
