            AMENDMENTS TO HOUSE BILL NO. 2297 (As amended by A06858)

     1       Amend Title, page 1, line 17 (A06858), by striking out "and"
     2    where it appears the first time
     3       Amend Title, page 1, line 20 (A06858), by removing the period
     4    after "tax" and inserting
     5               ; and providing for work performed.
     6       Amend Bill, page 5, by inserting between lines 33 and 34
     7    (A06858)
     8       Section 4.1.  The act is amended by adding a section to read:
     9    Section 1301.1.  Work performed.
    10       When a political subdivision has provided, approved or
    11    authorized a tax abatement or tax exemption for a property or
    12    project under this act, all construction, reconstruction,
    13    demolition, alteration and repair work other than maintenance
    14    work performed on a property shall be done in accordance with
    15    the act of May 1, 1913 (P.L.155, No.104), referred to as the
    16    Separations Act, and the act of August 15, 1961 (P.L.987,
    17    No.442), known as the Pennsylvania Prevailing Wage Act, except
    18    that the acts shall apply to work funded by a person or business
    19    only if each of the political subdivisions in which the work is
    20    being performed has adopted an ordinance or resolution requiring
    21    that work funded by a person or business shall be subject to the
    22    Separations Act and the Pennsylvania Prevailing Wage Act. For
    23    purposes of this act, maintenance work means repair of existing
    24    facilities when the size, type or extent of the facilities is
    25    not thereby changed or increased.

    26       Amend Sec. 5, page 5, line 34 (A06858), by striking out all
    27    of said line and inserting
    28       Section 5.  This act shall apply as follows:
    29           (1)  The amendment of section 515 of the act shall

    30       Amend Sec. 5, page 5, by inserting between lines 35 and 36
    31    (A06858)

     1           (2)  The addition of section 1301.1 of the act shall
     2       apply to all contracts entered into on or after the effective
     3       date of this act.
