                       AMENDMENTS TO HOUSE BILL NO. 1202

     1       Amend Sec. 4, page 3, lines 12 and 13, by striking out all of
     2    said lines and inserting
     3           (1)  (i)  All diesel fuel sold or offered for sale in
     4           this Commonwealth for use in on-road compression ignition
     5           engines

     6       Amend Sec. 4, page 3, lines 18 and 19, by striking out all of
     7    said lines and inserting
     8               (ii)  If the in-State production volume of biodiesel
     9           is less than 30 million gallons for any period of three
    10           months on an annualized basis, then the requirement of 2%
    11           biodiesel by volume under subparagraph (i) shall be
    12           suspended until such time as the threshold in-State
    13           production volume required under subparagraph (i) is
    14           satisfied.
    15           (2)  (i)  All diesel fuel sold or offered for sale in
    16           this Commonwealth for use in on-road compression ignition
    17           engines

    18       Amend Sec. 4, page 3, lines 24 and 25, by striking out all of
    19    said lines and inserting
    20               (ii)  If the in-State production volume of biodiesel
    21           is less than 75 million gallons for any period of three
    22           months on an annualized basis, then the requirement of 5%
    23           biodiesel by volume under subparagraph (i) shall be
    24           suspended until such time as the threshold in-State
    25           production volume required under subparagraph (i) is
    26           satisfied.
    27           (3)  (i)  All diesel fuel sold or offered for sale in
    28           this Commonwealth for use in on-road compression ignition
    29           engines

    30       Amend Sec. 4, page 4, lines 2 and 3, by striking out all of
    31    said lines and inserting
    32               (ii)  If the in-State production volume of biodiesel
    33           is less than 150 million gallons for any period of three

     1           months on an annualized basis, then the requirement of
     2           10% biodiesel by volume under subparagraph (i) shall be
     3           suspended until such time a the threshold in-State
     4           production volume required under subparagraph (i) is
     5           satisfied.
     6           (4)  (i)  All diesel fuel sold or offered for sale in
     7           this Commonwealth for use in on-road compression ignition
     8           engines

     9       Amend Sec. 4, page 4, by inserting between lines 9 and 10
    10               (ii)  If the in-State production volume of biodiesel
    11           is less than 300 million gallons for any period of three
    12           months on an annualized basis, then the requirement of
    13           20% biodiesel by volume under subparagraph (i) shall be
    14           suspended until such time as the threshold in-State
    15           production volume required under subparagraph (i) is
    16           satisfied.
